the Virginia Department of Transportation, the Albemarle County Service Author-
ity, and the Thomas Jefferson Health District require these items on plats and plans
submitted for preliminary approval. Plats and plans will not be rejected if these
items are not present, but they are required for approval. These items are provided
in an effort to communicate all preliminary comments.

Dear Ms. Pickart:
Enclosed for your review is a copy of an agreement between Virginia's First Family of
Fine Cars, Inc. and itself as owner of both tax map parcels 78-14 and 78-14A regarding a
landscaping agreement. You may recall that I discussed this issue with you several weeks ago in
connection with your request for recordation of an agreement between the owner of these two tax
map parcels regarding the installation, ownership and maintenance of landscaping required to be
planted along and adjacent to the boundary line between these two parcels pursuant to the
County's review of a site plan for Parcel 14A. I have also enclosed a copy of the clerk's receipt
evidencing recordation of this agreement on October 25, 1999 in the Albemarle County Circuit
Court Clerk's Office.

THIS AGREEMENT (this "Agreement"), is made as of this gilt day of
October, 1999, by and between VIRGINIA'S FIRST FAMILY OF FINE CARS,
INC., a Virginia corporation, its successors and assigns (the"Owner of Parcel 14") and
VIRGINIA'S FIRST FAMILY OF FINE CARS, INC., a Virginia corporation, its
successors and assigns (the"Owner of Parcel 14A").
WITNESSETH:
Recitals:
R-1. Virginia's First Family of Fine Cars, Inc., a Virginia corporation, is the
owner of that certain lot or parcel of land shown on the land records of Albemarle
County, Virginia as Tax Map Parcel 78-14 ("Parcel 14")
R-2. Virginia's First Family of Fine Cars, Inc., a Virginia corporation, is the
owner of that certain lot or parcel of land shown on the land records of Albemarle
County, Virginia as Tax Map Parcel 78-14A("Parcel 14A").
R-3. The property line between Parcel 14 and Parcel 14A consists of a slope of
land which requires the planting of trees, shrubs and other landscaping to prevent erosion
of the land, control rainwater runoff, and for other purposes.
R-4. The Owner of Parcel 14A has agreed to plant the necessary landscaping
along and adjacent to the boundary line between Parcel 14 and Parcel 14A, and desires to
maintain such landscaping.
R 5, The Owner of Parcel 14 has agreed to the planting, by the Owner of Parcel
14A, of such landscaping on the portion of Parcel 14 along and adjacent to the boundary
line with Parcel 14A, and has agreed to allow the Owner of Parcel 14A access to such
portion of Parcel 14 as necessary for the purposes of installation, maintenance and
replacement of the landscaping.
Agreement:
NOW THEREFORE, for and in consideration of the sum of Ten Dollars ($10.00)
cash in hand paid, the mutual covenants contained herein, and other good and valuable
consideration, the receipt and sufficiency of which are hereby acknowledged, the parties
hereto agree as follows:
1. The Owner of Parcel 14A shall plant trees, shrubs and other landscaping
along and adjacent to the boundary line between Parcel 14 and Parcel 14A, and shall
maintain all such trees, shrubs and other landscaping, including the portion of
landscaping which will be planted on Parcel 14.
2. The Owner of Parcel 14 grants permission to the Owner of Parcel 14A to
plant such trees, shrubs and other landscaping on the portion of Parcel 14 along the
boundary line with Parcel 14A, and further grants to the Owner of Parcel 14A an
easement over such portion of Parcel 14 as necessary to carry out the installation,
maintenance and replacement of the landscaping.
3. This Agreement shall be binding upon the Owner of Parcel 14, its
successors and assigns, and the Owner of Parcel 14A, its successors and assigns, and
shall run with the parcels in perpetuity.
