Dear Mr. Miller:
Your request for a Zoning Clearance for Farm Sales use on the parcel listed above is approved in
accordance with Section 5.1.47 of the Zoning Ordinance. The request is as follows:
Single - vendor retail outlet for agricultural products produced by Timbercreek Farm,
including but not limited to fresh vegetables and a selection of pre- packaged USDA
inspected and labeled meats. Approximately 100 square feet will be used for farm sales
and is proposed to be located in a 10x10 tent adjacent to an existing barn on the property.
The entrance to the property has been reviewed by the Virginia Department of Transportation and
approved for this use. Please see the attached e-mail from Joel D. DeNunzio, P.E. and item #3.
Your application was sent to the Virginia Department of Health, who has forwarded the information on to
the Virginia Department of Agriculture and Consumer Services ( VDACS). Zoning Clearance approval is
not dependent on Virginia Department of Health or VDACS approval prior to the County's action on
your Zoning Clearance. You should comply with their regulations and permitting requirements as
applicable.

We have reviewed the application for a produce stand and the entrance for the existing Tim bercreek
Farm Road entrance to Garth Road in accordance with the VDOT standards for a commercial entrance
_-and have the following comments:
1. The existing entrance meets the minimum sight distance requirements in accordance with the
VDOT Road Design Manual, Appendix F.
2. The existing entrance meets the minimum geometrical and surface requirements in the VDOT
Road Design Manual.
3. The gate at the entrance to Garth Road should remain open at all times of operation of the
produce stand.
4. 1 have reviewed the e -mails of complaints of excessive speed on Garth Road and also have
reviewed the Albemarle County Police responses to these complaints. The police records
indicate that there are not excessive speeding problems that they have observed on Garth Road
in this area and the crash rates are not high for the amount of traffic. If speeding continues to
be a concern for the adjacent residents, requests for speed studies and reductions of speed
limits should be made to VDOT from the Albemarle County Board of Supervisors.

Timbercreek Family Farm LLC is hereby applying for a zoning clearance to
open a retail farm stand on the property wholly owned by Timbercreek Family Farm
LLC, The "Stand" will consist of a 10 foot by 10 foot tent that will be located at the
end of Timbercreek Road Charlottesville, VA 22901. Products offered for sale will j
be fresh vegetables and a selection of pre- packaged USDA inspected and labeled
meats produced solely by Timbercreek Familly Farm and labeled accordingly.
Enclosed with this letter is the standard application form and a check for
$50.00 to cover the Zoning Clearance fee required. Thank you in advance for your
