Box 213 Keene, Va. 22946 RE: PROJECT: SP201000057 Pine Knot Historical Center (Sign #57) TAX MAP /PARCEL: 12200000001100 Dear Ms. Beazley: On July 11, 2012, the Albemarle County Board of Supervisors took action on the above referenced special use permit to allow the Pine Knot Historical Center on TAX MAP 122, PARCEL 11 in the Scottsville District. This special use permit was approved based on the following conditions: Development and use shall be in general accord with the conceptual plan titled "Ex. Conditions and Site Plan Special Use Permit — SP #201000057" prepared by Water Street Studio and dated (last revised) March 22, 2012 (hereafter "Conceptual Plan "), as determined by the Director of Planning and the Zoning Administrator. To be in general accord with the Conceptual Plan, development and use shall reflect the following major elements within the development essential to the design of the development, as shown on the Conceptual Plan: • limits of disturbance; • location of buildings and structures; and • location of parking area and associated BMPs for storm water management. Minor modifications to the plan, which do not conflict with the elements above, may be made to ensure compliance with the Zoning Ordinance. Transportation to and from the Pine Knot property for attendees of all special events shall be subject to a transportation management plan approved by the Planning Director. 3. Approval from the Health Department for the composting restroom facility shall be required prior to issuance of a building permit for this use. 4. Construction of the new building, as identified on the conceptual site plan (Attachment C -copy on file), shall commence on or before July 11, 2018, or this special use permit shall be deemed abandoned and the authority granted hereunder shall thereupon terminate. In addition, the Board, by a vote of 6:0, approved three (3) special exceptions for zoning ordinance modifications as follows: Modified Section 5.1.42(a) to permit an increase in the maximum aggregate square footage for the historical center from 1,500 to 1,700 square feet; 2. Modified Section 5.1.42(d) to waive the submittal of a site plan; and Modified Section 5.1.42(i) to permit an increase in the total maximum attendees at special events from 150 to 200 people. Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property as approved above may lawfully begin until all applicable approvals have been received and conditions have been met. this includes: compliance with conditions of the SPECIAL USE PERMIT; and approval of a ZONING COMPLIANCE CLEARANCE. Enclosed please find the approved traffic management plan as discussed in condition number two above. The plan has been modified to reflect the allowance of up to 200 attendees at special events. In the event that the use, structure or activity for which this special use permit is issued is not commenced within seventy -two (72) months from the date of Board approval, it shall be deemed abandoned and the permit terminated. The term "commenced" means "construction of any structure necessary to the use of the permit." Generally, pursuant to site guidelines, attendance at special events is by prearrangement or confirmation which permits the Foundation to approximate the number of cars that will b" during such events. Because attendance at any of these special events is limited to invited guests (excluding board of director members of the Foundation and their spouses) many of which are in the same family or will travel together, generally this attendance results in approximately 80 cars for which parking is required at such events. The Virginia Department of Transportation has determined the number of cars, even if substantially larger than the estimated number, will not impact the roadway, as the entrance is a commercial entrance with sufficient visibility to accommodate the increased traffic flow and the state road is sufficient to handle this traffic flow. With regard to parking onsite, the site has a graveled parking lot that can accommodate approximately 40 cars. In addition, there is additional cleared grassed parking on either side of the graveled entrance loop that should accommodate an additional 35 cars. In addition, the Foundation plans to create grassed overflow parking onsite that will accommodate approximately 40 cars. At any time it is determined the number of cars estimated to be onsite will exceed available parking, the Foundation will either: 1) limit the number of participants or the number of automobiles in which participants are arriving to stay within the limits of the number of parking spaces available or 2) make arrangements for additional overflow parking with Christ Church Glendower, which is approximately 1 %Z miles from the site, and arrange for transportation from that parking area to the Pine Knot site. Since events at Pine Knot are generally not during the hours in which church services are held at Christ Church, there should be no conflict in the needs of parking as between Christ Church and Pine Knot. At any event in which the expected number of cars onsite will exceed 40, the Foundation will arrange for parking directors to ensure cars are parking in an orderly fashion within the spaces available and the additional parking areas to assist cars in the safe and orderly entrance and exit from designated parking areas. Provided the special events are held on weekends, the Garden Club tour of Pine Knot or other charitable or non profit special events may be excluded from the requirements of this plan. This parking plan may be amended from time to time by written request of the Foundation and approval of the Director of Planning. Witness the following duly authorized signatures.
