Dalton (Sign # 89), Tax Map 94, Parcel 90 Dear Mr. Dalton: On August 4, 2004, the Albemarle County Board of Supervisors took action on SP- 2004 -14 to allow Home Occupation Class B for Furniture Making in accord with Section 10.2.2.31 of the Zoning Ordinance, which allows for Home Occupations Class B. This special use permit was approved based on the following conditions: 1. The number of vehicle trips per week associated with this home occupation shall not exceed ten (10); 2. The use shall be conducted in general accord with the concept plan identified as Attachment B in the staff report; 3. The total square footage of the shop building, including the study, shall not exceed eight hundred (800) square feet in size; and 4. No business sign shall be permitted. In the event that the use, structure or activity for which this special use permit is issued shall not be commenced within twenty -four (24) months after the issuance of such permit, the same shall be deemed abandoned and the authority granted thereunder shall thereupon terminate, For purposes of this section, the term "commenced" shall be construed to include the commencement of construction of any structure necessary to the use of such permit within two (2) years from the date of the issuance. Please be aware that establishment and operation of a Home Occupations, Class B use is subject to supplementary regulations of the Zoning Ordinance (Section 5.2). Copies of the supplementary regulations are attached. Before beginning this use, you must obtain a zoning clearance from the Zoning Department. Cc: Amelia McCulley Bill Fritz Tex Weaver Chuck Proctor Keith Lancaster FINE FURNITURE MAKER 3830 WHITETAIL LANE, KESWICK, VA 22947 February 2, 2012 Department of Community Development County of .Albemarle 401 McIntire Road, Charlottesville VA 22902 To Whom It May Concern: This letter is added to my Application for Zoning Clearance to explain the circumstances of my late application in regards to special use permit, SP- 2004 -14, granted to me by the County Board of Supervisors, August 4, 2004. The special use permit was related to my new business as a custom furniture maker. I mistakenly understood the letter dated August 27, 2004, from Mr. Benish, Chief of Planning, telling me of Board of Supervisor's approval, to be the necessary zoning clearance I needed before undertaking my business. I did not actively begin my business until June, 2005. After receiving my special use permit notification, I then proceeded to obtain the necessary building permits to expand my existing shop with attached office to better house my new business. My certificate of occupancy for the expanded shop /office building was granted on January 12, 2oo6. Recently, while compiling the necessary documents to change my business from a sole proprietorship to a single - member limited liability company, I reviewed Mr. Benish's letter. When I realized I had misunderstood the letter as my zoning clearance, I immediately contacted the Department of Community Development on January 31, 2012. Mr. Francis MacCall, of Zoning Services, recommended that I file my Application for Zoning Clearance in order to correct my oversight. His opinion was that no late filing penalty would be assessed against my application. In conducting my furniture making business, I have complied with all of the conditions attached to the Board of Supervisor's approval, as described in Mr. Benish's letter of August 27, 2004.
