Northeast corner units /acre. of the intersection of Hickory Street and Bitternut Lane. Hickory Street approximately 2,100 feet from the intersection of Old Lynchburg Road and Hickory Street. Plan Designation: Neighborhood Density Residential - residential (3 -6 units /acre) and supporting uses such as religious institutions, schools and other small -scale non - residential uses. Character of Property: Developed with residential use; the Use of Surrounding Properties: Single family subject site currently has mailboxes, parking area, an office residential, school, church, recreation facility and land and a community center used for the Boys and Girls Club, that is currently vacant and wooded that will be a Habitat , and Southwood. There are steep slopes at the state park rear of the existing building that slope up the hill toward some mobile homes. (Attachment C) Factors Favorable: Factors Unfavorable: 1. There are no factors unfavorable. 1. This proposal will provide a much needed comprehensive youth development service for more youth who live in the Southwood Community. 2. This proposal will provide a larger community center /meeting place for the entire Southwood community. 3. The renovations to the building and facilities will enhance the site. RECOMMENDATION: Staff recommends approval of SP 201200009, Southwood Boys & Girls Club Expansion with conditions. Southwood Boys & Girls Club Expansion Planning Commission Public Hearing July 31, 2012 STAFF PERSON: Claudette Grant PLANNING COMMISSION: July 31, 2012 BOARD OF SUPERVISORS: To Be Determined SP201200009: Southwood Boys & Girls Club Expansion Petition: PROJECT: SP201200009 Southwood Boys & Girls Club Expansion PROPOSAL: Request to allow the expansion of the existing Community Center on approximately 1 acre. No dwellings proposed. ZONING: R -2 which allows residential uses at a density of 2 units /acre. Section 14.2.2.1 Community Center. ENTRANCE CORRIDOR: Yes COMPREHENSIVE PLAN: Neighborhood Density Residential — residential (3 -6 units /acre); supporting uses such as religious institutions, schools, and other small -scale non - residential uses in Development Area Neighborhood 5. LOCATION: Southwood Mobile Home Park. 387 Hickory Street. Northeast corner of the intersection of Hickory Street and Bitternut Lane. Hickory Street approximately 2,100 feet from the intersection of Old Lynchburg Road and Hickory Street. TAX MAP /PARCEL: 090Al0000001 DO Character of the Area and Adjoining properties: The property is located in the Southwood Mobile Home Park in the northeast corner of the intersection of Hickory Street and Bitternut Lane. Hickory Street is approximately 2,100 feet from the intersection of Old Lynchburg Road and Hickory Street. Uses adjacent and near to the site include single family residential, school, church, recreation facility and land that is currently vacant and wooded that will be a state park. There are several residential subdivisions located nearby as well as Interstate -64. The buildings located on the site vary in age with some buildings in need of renovation. The Southwood community is primarily made up of mobile homes that are residential uses. The building proposed for a small addition with this special use permit request is an office and community space used by the Boys and Girls Club. It was the former neighborhood store. The Covenant School is located northeast of the site and an area located adjacent and to the south of the site is slated to be a state park. The Mosby Mountain subdivision is located to the west and across Old Lynchburg Road. Background: The property is zoned R- 2- Residential and developed primarily as the Southwood Mobile Home Park. SP200700062 was approved on May 14, 2008 to allow the expansion of the former store space to accommodate up to 80 youth members and improve the basketball court, play field /yard, surface of lot in front of building and the fagade of existing building. The facility is now at full capacity (80 children) and the applicant would like to amend the special use permit to allow an increase of up to 40 additional children, bringing the total allowed children on site to 120. In order to accommodate the additional children, the applicant proposes the addition of a transportable, modular building of up to 1,920 square feet, and a small addition of approximately 360 square feet to the existing structure /community space at the site. (See Attachment C) 2 Southwood Boys & Girls Club Expansion Planning Commission Public Hearing July 31, 2012 Applicant's Justification for the Request: The Boys and Girls Club (BGC) has been operating in the Southwood community for several years. It has become very successful in serving as a safe haven for the community children and is considered a pillar of the Southwood community. As a result, BGC wishes to serve a greater number of youth and improve and strengthen the already model relationship they currently have in the community. In order to serve additional youth BGC also needs to have an expanded facility to provide the programs that are needed to continue their success. Planning and Zoning History: Southwood Mobile Home Park developed in 1976. The property was zoned R -2 residential prior to 1980. Over the last 25 to 30 years a variety of home occupations, violations, zoning clearances, signs, and two Special Use Permits (SP 2001 -004 and SP2007 -062) have occurred on the site. SP2001 -004 was a special use permit approved with conditions for Rainbow House, a community center located at 750 Java Court. SP2007 -062 was a special use permit approved on May 14, 2008 with conditions for expansion and site improvements for the BGC. Conformity with Comprehensive Plan: The Land Use Plan designates this area as Neighborhood Density Residential in Neighborhood Five (5). The Comprehensive Plan supports community center uses, institutional uses such as places of worship, public and private schools, and early childhood education centers including day care centers and preschools. A community center is appropriate within this land use designation and for this area, as it is surrounded by a variety of uses including several different types of residential uses and institutional uses. A full Neighborhood Model Analysis is not applicable for this project since it is an existing development and does not propose re- development, but proposes improvements to existing facilities /buildings and a connection to a new transportable, modular building. Those Principles that this special use permit request supports are a mixture of uses and the provision of a neighborhood center. Staff Comment on SP 2012 - 00009 - Request for a Community Center Use in the R- 2 Residential District Section 31.6 of the Zoning Ordinance below requires that special use permits be assessed as follows: Will the use be of substantial detriment to adjacent property? The proposed expansion /renovation and addition of a modular building for the community center are not expected to have detrimental impacts on the adjacent properties. The Boys and Girls club has been operating in this general location at Southwood for many years. Although the center and club are located within a residential community, there is a need for this service and its expansion to serve more youth and provide a good meeting space for the residents of the community. Will the character of the zoning district change with this use? The character of the district is not anticipated to change with the expansion of the building Southwood Boys & Girls Club Expansion Planning Commission Public Hearing July 31, 2012 space for this use. The existing site is established in the community. The building has served as a neighborhood store, office, community center and facility for the Boys and Girls Club. The additional building, and proposed expansion and renovation of the existing building, will provide a larger space for the Boys and Girls Club and a community center for the residents of Southwood with more office space. The character of the district will not change and the addition and renovations to the site will provide much needed improvements for this neighborhood center. Will the use be in harmony with the purpose and intent of the zoning ordinance? The R -2 zoning district is intended for residential uses. However, community centers are allowed by special use permit, if sited appropriately. The community center is viewed as a use supportive to the Southwood community. The uses requested in this special use permit provide a service amenity in the district. Will the use be in harmony with the uses permitted by right in the district? This area contains a wide mix of existing uses; a state park, church, private school, and a mix of residential uses. Community Center uses are allowed in the R -2 district with a special use permit. The community center facility is relatively low impact and a supportive use to the existing residential uses. These uses are therefore viewed as compatible with the residential uses allowed in the R -2 District. Will the use comply with the additional regulations provided in Section 5.0 of this ordinance? Section 5.1.04 COMMUNITY CENTER states that "Any such use seeking public funding shall be reviewed by the commission in accordance with section 31.2.5. Specifically, the commission shall find that the proposed service area is not already adequately served by another such facility. In addition, the commission shall be mindful that such use is appropriate to villages, communities and the urban area of the comprehensive plan." Staff is not aware of any recent approved special use permit requests for a community center in this general area. The proposed community center would be available for all residents of the Southwood Mobile Home Park. Staff believes that Southwood Mobile Home Park is not already adequately served by another facility and expansion of this use in this location is appropriate in this part of the urban area. Will the public health, safety and general welfare of the community be protected if the use is approved? The public health, safety, and general welfare of the community are protected through the special use permit process which assures that the proposed use is appropriate in the location requested. There are no safety concerns with the proposed community center use. Summary: Staff finds the following factors favorable to this request: 1. This proposal will provide a much needed comprehensive youth development service for more youth who live in the Southwood Community. 2. This proposal will provide a larger community center /meeting place for the entire Southwood community. 3. The renovations to the building and facilities will enhance the site. 4 Southwood Boys & Girls Club Expansion Planning Commission Public Hearing July 31, 2012 Staff finds no unfavorable factors with to this request. Recommendation: Staff recommends approval of SP 201200009, Southwood Boys & Girls Club Expansion with the following conditions of approval: Development shall be in general accord with the concept plan dated Fmohri i °r" 26, 2008 titled Southwood Boys and Girls Club Expansion, dated April 13, 2012 (hereafter "Concept Plan "), as determined by the Director of Planning and the Zoning Administrator. To be in accord with the Concept Plan, the proposed building and existing building renovation and use shall reflect the following major elements within the site essential to the design of the site, as shown on the Concept Plan: Location of buildings, uses, and structures, inclusive of the minimum setback for the new structure from Bitternut Lane must be 15 feet. Location of parking areas Location of outdoor play area Minor modifications to the plan which do no conflict with the elements above may be made to ensure compliance with the Zoning Ordinance; and 2. The parking study is based on a maximum of eighty 0) one hundred twenty (120) children. There shall be no more than eighty (80) one hundred twenty (120) children served at this location of the Boys and Girls Club. PLANNING COMMISSION MOTION — Special Use Permit: A. Should a Planning Commissioner choose to recommend approval of this special use permit: Move to recommend approval of SP 2012 - 00009, Southwood Boys & Girls Club Expansion with the following conditions: Development shall be in general accord with the concept plan titled Southwood Boys and Girls Club Expansion, dated April 13, 2012 (hereafter "Concept Plan "), as determined by the Director of Planning and the Zoning Administrator. To be in accord with the Concept Plan, the proposed building and existing building renovation and use shall reflect the following major elements within the site essential to the design of the site, as shown on the Concept Plan: Location of buildings, uses, and structures, inclusive of the minimum setback for the new structure from Bitternut Lane must be 15 feet. Should a Planning Commissioner choose to recommend denial of this special use permit: Move to recommend denial of SP 2012 - 00009, Southwood Boys & Girls Club Expansion. Should a commissioner motion to recommend denial, he or she should state the reason(s) for recommending denial.
