HomeMy WebLinkAboutSP201200015 Legacy Document 2012-08-14b$ vo �'IRGII�P COUNTY OF ALBEMARLE Department of Community Development 401 McIntire Road, North Wing Charlottesville, Virginia 22902 -4596 Phone (434) 296 -5832 Fax (434) 972 -4126 August 9, 2012 Stephen Waller, AICP 536 Pantops Center Charlottesville, Va. 22911 RE: SP- 2012 -00015 Verizon Wireless Colthurst- Ingleridge LLC., Tier III Personal Wireless Service Facility (Signs # 20 & 21) TAX MAP /PARCEL: 06000- 00- 00 -002AO Dear Mr. Waller: On August 1, 2012, the Albemarle County Board of Supervisors took action on SP201200015 to allow installation of a six new flush- mounted antennas on an existing tower which will involve retrofitting an extension mount to a new height of 139 feet, relocation of the existing antenna array and changes to associated ground equipment on Tax Map 60 Parcel 2A in the Jack Jouett District. This special use permit was approved based on the following conditions: Development and use shall be in general accord with what is described in the applicant's request and site plans, entitled " Colthurst LTE 4G Upgrade:, with a final zoning drawing submittal date of 6/25/12 (hereafter "Conceptual Plan "), as determined by the Director of Planning and Zoning Planning Administrator. Minor modifications to the plan which do not conflict the elements above may be made to ensure compliance with the Zoning Ordinance. In addition, the Board of Supervisors approved, by a vote 6:0, the special exceptions for the modifications to Chapter 18, Zoning Ordinance Sections 5.1.40(c)(3)(i),(c)(4), (c)(5), (d)(5), and (d)(6) under the special exception criteria of Section 31.8. Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property as approved above may lawfully begin until all applicable approvals have been received and conditions have been met. This includes: • compliance with conditions of the SPECIAL USE PERMIT; • approval of and compliance with a SITE PLAN; and • approval of .a ZONING COMPLIANCE CLEARANCE. In the event that the use, structure or activity for which this special use permit is issued is not commenced within twenty -four (24) months from the date of Board approval, it shall be.deemed abandoned and the permit terminated. The term "commenced" means "construction of any structure necessary to the use of the permit."
