This DEED OF VACATION, made this A day of Ai, 2012, by and between the
COUNTY OF ALBEMARLE, VIRGINIA, a political subdivision of the Commonwealth of
Virginia, indexed as Grantor and Grantee, and TREESDALE, LP, a Virginia limited
partnership, indexed as Grantor and Grantee.
WITNESSETH
Recitals
Treesdale LP is the owner of that certain real property located in Albemarle County,
Virginia, shown and designated as Albemarle County Tax Map Parcel 61 -182 (the "Property ") as
shown on the plat attached hereto as Exhibit A entitled "30 Square Feet Being a Portion of the
Dedicated Right of Way for Rio Road East Hereby Vacated and Added and Combined to
Treesdale, LP" (the "Plat ") made by G.V. "Kirk" Hughes, certified Land Surveyor Lic. No.
1458, dated June 8, 2012.
Treesdale LP has developed the Property as a multi - family residential development
(herein "Treesdale "). Treesdale is served by Rio Road East (State Route 631).
A portion of the block wall located on the Property extends into the existing public right
of way of Rio Road which was dedicated to public use as shown on that certain Plat of Survey
entitled "9,087 Square Feet Being a Portion of the Lands of Treesdale, L.P. Hereby Dedicated to
Public Use and Various Easements Hereby Vacated as Shown Hereon Located on Rio Road
East" which survey is recorded in Deed Book 4113, page 15.
The parties hereto, being all of those necessary owners under Section 15.2- 2271(1) of the
Code of Virginia (1950), as amended, wish to vacate that portion of the dedicated right of way
consisting of thirty (3 0) square feet as shown and described on the Plat as "30 S.F. (Hereby
Vacated)." The vacation of said portion of Rio Road East (State Route 63 1) will not impede
public use of Rio Road East or access to Treesdale.
NOW THEREFORE, pursuant to Section 15.2- 2272(1) of the Code of Virginia (1950), as
amended, the County of Albemarle, Virginia and Treesdale, LP, hereby VACATE that portion of
the Rio Road East right of way shown and described on the Plat as "30 S.F. (Hereby Vacated)."
Pursuant to Section 15.2 -2274 of the Code of Virginia (1950), as amended, title to the
property hereby vacate is vested in the adjacent property owner, that is, title to the thirty (30)
square feet as shown on the Plat as hereby vacated is vested in Treesdale, LP. Said vacated
property shall be added to and become part of the property of Treesdale, LP, tax map number 61-
182.
