HomeMy WebLinkAboutSP201200016 Legacy Document 2012-08-30COUNTY OF ALBEMARLE Department of Community Development 401 McIntire Road, North Wing Charlottesville, Virginia 22902 -4596 Phone (434) 296 -5832 Fax (434) 972 -4126 REVISED ACTION LETTER - PLEASE SEE BOLD AND UNDERLINE FOR CHANGES August 16, 2012 Jessie Wilmer 1150 Shenandoah Village Dr. Waynesboro, Va. 22980 RE: SP201200016 Ntelos Wireless —CV825 Cedar Hill — Tier III TAX MAP /PARCEL: 090BO -00 -OA -01100 Dear Ms. Wilmer: On August 1, 2012, the Albemarle County Board of Supervisors took action on SP201200016 to allow a one hundred and fifteen (115) foot tall steel monopole tower painted brown with a flush- mounted antenna array consisting of three (3) panel antennas and associated ground equipment which will be located within a twenty (20) foot by thirty (30) foot leased compound area. The access road to the proposed facility is an existing paved road on Tax Map Parcel 090BO-00-OA-01 1 00in the Scottsville District. This special use permit was approved based on the following conditions: Development and use shall be in general accord with the conceptual plan titled "Cedar Hill (UVA Foundation Property) CV825" prepared by Brian Crutchfield and dated 7 -24 -12 (hereafter "Conceptual Plan "), as determined by the Director of Planning and the Zoning Administrator. To be in general accord with the Conceptual Plan, development and use shall reflect the following major elements within the development essential to the design of the development, as shown on the Conceptual Plan: a. Height b. Mounting type c. Antenna type d. Number of antenna e. Distance above reference tree f. Color g. Location of ground equipment Minor modifications to the plan which do not conflict with the elements above may be made to ensure compliance with the Zoning Ordinance. In addition, the Board of Supervisors approved, by a vote 6:0, the special exceptions for the modifications to Chapter 18, Zoning Ordinance Sections 5.1.40(d)(6) and the special exception to allow the disturbance of critical slopes, Section 4.2.3.2 Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property as approved above may lawfully begin until all applicable approvals have been received and conditions have been met. This includes: compliance with conditions of the SPECIAL USE PERMIT; approval of and compliance with a SITE PLAN; and approval of a ZONING COMPLIANCE CLEARANCE. In the event that the use, structure or activity for which this special use permit is issued is not commenced within twenty -four (24) months from the date of Board approval, it shall be deemed abandoned and the permit terminated. The term "commenced" means "construction of any structure necessary to the use of the permit."
