Main St., Suite 500 Spartanburg, SC 29302 Re: LZC2012-007 —The Haven @ Stonefield, Proposed Lot E2, containing 7.638 Acres, Albemarle County Virginia (the "Property") Ladies and Gentlemen: At the request of Williams Mullen, we have examined our records with respect to that certain parcel of real property located in Albemarle County, Virginia (hereinafter, the "Property"), described as follows: that certain proposed parcel of land containing 7.638 acres, and shown on a subdivision plat prepared by WW Associates entitled "Plat Showing Subdivision of Stonefield," dated July 15, 2011, last revised November 10, 2011, and identified by Albemarle County as SUB2011-118 (the "Subdivision Plat"), as "Lot E2 332,706 SF, 7.638 Ac." on sheet 6 of 8 of the Subdivision Plat. On behalf of the Zoning Administrator for Albemarle County, I hereby certify the following information: 1. The Property is currently zoned Neighborhood Model Development ("NMD"). 2. The Property is part of a larger project currently known as "Stonefield" and which was previously known as "Albemarle Place." 3. Albemarle County approved the Subdivision Plat on February 17, 2012. Upon valid recordation of the Subdivision Plat, the Property will be a legal parcel of record that may be legally sold and. conveyed.. 4. The uses that are permitted within the Project are regulated by the Code of Development for Albemarle Place entitled "ZMA Code of Development, Albemarle Place" as approved by the Board of Supervisors on October 22, 2003 as part of ZMA 2001-007, and as amended by the Board of Supervisors on August 4, 2010, as part of ZMA 2008-0003, and a copy of which is attached hereto as "Exhibit A" (the "Code of Development"). Appendix A of the Code of Development lists the uses that are permitted within each block of the Project. The Property is located within block E of the Project. Appendix A permits multi -family dwellings as a permitted use within block E. 5. Albemarle County approved a final site plan on February 10, 2012 for the Property entitled "Stonefield Block E2, The Haven at Stonefield, Final Site Plan, Albemarle County, Virginia," prepared by M Associates, dated August 26, 2011, and identified by the County as SDP2011-057 (the "Final Site Plan"). The Final Site Plan permits the construction of 250 multi -family dwelling units and associated improvements on the Property subject to the valid issuance of a building permit and subject to the terms and conditions of the Final Site Plan. 6. If the Property is developed in conformance with the Final Site Plan, it will be in compliance with the Albemarle County zoning ordinance and all other applicable regulations. 7. The County is in the process of reviewing building permit applications (B2012- 221, 226-235) for this Property, and provided that all is in order, the County Building Official or his designee will issue a building permit for the construction of the dwelling units and other improvements shown on the Final Site Plan. 8.
