DISCUSSION:
The applicant requested indefinite deferral of this Special Use Permit request on
May 2, 2011, in order to address outstanding issues related to the proposed
project. According to Section 33.7(b) of the Zoning Ordinance, the Planning
Commission or Board of Supervisors needs to take an action on this request
within 12 months after the date the deferral was requested or the request will be
deemed "voluntarily" withdrawn. As also permitted under Section 33.7, the
Planning Director granted an extension, which will expire on October 31St, 2012.
The applicant is actively pursuing approval of the special use permits, and staff
has the necessary information to complete the reviews. However, the extension
will expire before the requests can be heard by the Commission in November.
As a result, this Special Permit request has been scheduled for the October 23,
2012 Planning Commission meeting in order for the Commission to take action to
defer the project to November 13, 2012. This action by the Commission will
satisfy the requirements Section 33.7 to avoid voluntary withdrawal of the project.
RECOMMENDATION:
Staff recommends that the Planning Commission defer SP2010 -00049
Howardsville Camping and SP2010 -00050 Howardsville Canoe Livery until
November 13, 2012.
