McFarland conveyed 10.1 acres to Richard T. and Martha M. Selden according to an attached plat by William S. Roudabush, Inc. recorded on page 511. This plat shows the 10.1 acres as 2 lots of 5.05 acres each. These lots are currently shown on Albemarle County Tax Map 58 as parcel 64K. As stated in a letter to you (see attached item 4(a)), Mr. Selden and his wife intended for the property to be two separate lots when they purchased it from the McFarlands. A bill from the office of William S. Roudabush, Inc. for the specific service of dividing what had previously been a single lot (see attached item 4(b)) is further evidence of Mr. Selden's intent. Though there have been several deeds conveying one half of the interest in this property, the other half interest has been continuously owned by Mr. Selden. We believe the property currently shown as Parcel 64K on Tax Map 58 consisted of two separate lots on December 10, 1980 and that no act has been done to combine them. Our. home, at 1247 Turner Mountain Road, sits on a 10.1 acre lot. My first wife (Martha M. Selden) and I acquired this acreage from Carl and Patricia McFarland on July 7, 1976. About a year later we began construction of a home on the northwest corner of the lot; we moved into this home on May 30, 1978. In the months prior to the July 1976 purchase Martha and I spent a lot of time considering how much land to buy from the McFarlands. We knew our finances would be stretched very thin by the cost of the home we were planning, yet we wanted a large enough lot to assure us of total privacy. We finally settled on the 10.1 acre lot size after learning from our surveyor, William Roudabush, that we could split the lot into two parcels of 5.05 acres. We were advised (by both Mr. Roudabush and Mr. McFarland, a lawyer) that by recording a plat with the county showing such a division we could establish our right to sell the lower 5.05 parcel at some future date. For the last 30 years I have believed that by attaching Mr. Roudabush's revised plat of May 4, 1976 to the July 7, 1976 deed we had succeeded in establishing this right. There should be no doubt about our motivation in asking Mr. Roudabush to add the dividing line shown on his plat of May 4, 1976. We would not have been willing to spend more money on surveyor's services unless there was a clear financial advantage in doing so. The advantage we saw was the ability to raise cash by selling off the lower 5.05 acres, if we later found ourselves in financial deep waters. In closing, I want to mention one other fact that may be relevant to your deliberations. Our 10.1 acre property fronts on, and is accessed by, an additional 4.808 acre 50 -foot -wide strip of land that I have owned since 1981. This strip (Tax Map 58, Parcel 64E9) extends all the way to US 250. As you probably know, I have retained Roger Ray to assist in assembling information pertinent to your ruling on this matter.
