Perez — Senior Planner PLANNING COMMISSION: November 13, 2012 AGENDA TITLE: SDP201200053 Albemarle County Public Safety Training Facility - Firearms Range - Preliminary Site Plan APPLICANT: Albemarle County Office of Facilities Development (OFD) PROPERTY OWNER(S): Albemarle County APPLICANT'S PROPOSAL: Request for approval of preliminary site plan for County owned & operated firearms training facility, associated classroom building, toilet facilities, access road and parking area. [Attachment A]. COMPREHENSIVE PLAN: The Comprehensive Plan designates this property as Rural Areas - preserve and protect agricultural, forestal, open space, and natural, historic and scenic resources/ density (0.5 unit/ acre in development lots). PLANNING HISTORY CCP201200001 Firearms Training Facility at Keene Landfill Site — On April 3, 2012 the Albemarle County Planning Commission found that the location, character and extent of the proposed Law Enforcement Firing Range Facility (Firearms Training Facility at Keene Landfill Site) is in substantial accord with the County's adopted Comprehensive Plan [Attachment D]. The review considered whether the general location, character and extent of a proposed public facility is in substantial accord with the adopted Comprehensive Plan. It was reviewed by the Planning Commission and the Commission's findings were forwarded to the Board of Supervisors for their information. No additional action was required of the Board. The Commission's action is only related to the appropriateness of the site for this public use, and is not an action or recommendation on whether the station should be funded and/or constructed. November 7, 2012 Board of Supervisor meeting to discuss the Firearms Training Facility at Keene Landfill Site — The Police Department and the Office of Facility Development (OFD) presented an extensive history and status update of the project. Following discussion and questions, the Board reaffirmed their support of the project as proposed. The motion passed 5 -0 (Mr. Dumler abstained). REASON FOR PLANNING COMMISSION REVIEW: Planning staff received letters from abutting owners requesting Planning Commission review of the preliminary site plan [Attachment C]. The abutting owners are concerned about the use being permitted in the proposed location and reference the rural areas classification of the land, the historic designation of the district, and the significant number of issues with this location as reasons for Planning Commission review. From various phone calls with adjacent owners it appears that their concerns are about the use (firearms range) rather than what is being proposed on the site plan. The use is permitted by right as a public use. STAFF COMMENT: The preliminary site plan was reviewed by all members of the Site Review Committee, including the Department of Environmental Quality (DEQ). During the review of the site plan Planning Staff assured compliance with items of discussion from the County Comprehensive Plan (CCP) review; such as: location of the range on the property, the orientation of the range on the property, and safety features of the range. The location of the proposed facility is within the approved area for the range to be located [Attachment E]. The orientation of the proposed facility is to the North as specified in the CCP review per suggestion by the Agricultural Forestal Committee. The range is surrounded on three (3) sides by 20 foot tall earthen berms as discussed during the CCP review. During the CCP review of the facility, no conditions were required. Issues of noise were reviewed and discussed in great detail during the CCP stage of this project and have no bearing on the preliminary site plan. A preliminary site plan must be approved if it satisfies the minimum requirements of the Zoning Ordinance, and may be approved with conditions that must be satisfied before the final site plan may be approved. Staff notes that there are four waivers requested for the site plan as proposed [Attachment F]: Waiver of Design Standards 1. Section 4.12.15a Access and Parking Lot Surface Material 2. Section 4.12.15g Curb and Gutter in Parking Lot and Access Waiver of Parking Lot Landscaping 3. Section 32.7.9.7(b) Interior Parking Lot Landscaping 4. Section 32.7.9.8(c)2 Screening of the Parking Lot These waivers need to be approved by the Board of Supervisors per Section 18 -31.8 Special Exceptions of the Zoning Ordinance. Staff is recommending approval of these waivers, and is providing this to the Planning Commission for informational purposes only [Attachment F]. FACTORS FAVORABLE AND UNFAVORABLE: Factors Favorable: 1. Site plan matches the approved proposal during CCP201200001 review. 2. No conditions were required during the CCP review. 3. Submittal meets preliminary site plan requirements. Factors Unfavorable: None RECOMMENDATION: Staff recommends approval of the preliminary site plan with the following conditions to be addressed during final site plan: RECOMMENDED CONDITIONS: Planning approval to include: ❑ Approval of required waivers by the Board of Supervisors ❑ Meet all the requirements in Chapter 18 Section 32 for final site plans, including landscape plans, and lighting plans. ❑ Virginia Department of Transportation approval of final plans. ❑ Approval by all required departments and agencies. ❑ [32.5.6b] Revise the parking study to meet the requirements of this section; revise to simply state the number of spaces required /needed for the proposed use. By saying "up to 20 people per use" and providing 30 spaces this exceeds the 120% of parking maximum. Please provide some additional parking need data to justify /account for a need for at least 25 spaces in order for the 30 space to comply. ❑ [32.5.6k] On the plan provide a note which indicates the source of water (for drinking and sanitation) for the mobile office trailer. ❑ [32.5.6n] On the plan extend the prepared, wheelchair accessible travel -way to the vault toilet as these must be handicap accessible. Engineering approval to include: ❑ The plan must meet all engineering requirements of the Water Protection, Subdivision, and Zoning Ordinances in addition to all engineering standards detailed in the County's Design Manual. Health Department approval to include: ❑ Approval of Vault Toilets Fire & Rescue approval to include: ❑ Must comply with the Virginia Statewide Fire Prevention Code. Final approval is subject to field inspection and verification. PLANNING COMMISSION MOTION: A. Should the Planning Commission choose to approve this Preliminary Site Plan: Move to approve SDP2012 -00053 subject to the conditions as recommended by staff. B. Should the Planning Commission choose to deny this Preliminary Site Plan: Move to deny SDP2012- 00053. Should a motion to deny move forward, the commission should state the reasons) for denial.
