Main Street, Suite M Charlottesville VA 22902 Re: SDP201200024, Timberwood Commons -Final Dear Justin: You requested via e-mail on October 30, 2012 that the indefinite deferral of the application for SDP201200024 Timberwood Commons be extended. Section 32.4.3.10 of the Albemarle County Zoning Ordinance says: "7f the applicant requests that further processing or formal action on the application for a final site plan be indefinitely deferred, the application shall be deemed to have been voluntarily withdrawn by the applicant if the agent, commission, or board of supervisors does not take action on the application within six (6) months after the date the deferral was requested. Upon written request received by the director of planning and community development before the application is deemed to be withdrawn, the director may grant one extension of the deferral period for a period determined to be reasonable, taking into consideration the size or nature of the proposed development, the complexity of the review, and the laws in effect at the time the request for extension is made." In an email dated May 29, 2012, you requested an indefinite deferral of this application to address the comments provided by the Site Review Committee on May 17, 2012. Based on your attached request, we understand that additional time is needed to address outstanding issues with VDOT regarding the proposed bus stop along Timberwood Boulevard. We also understand that once VDOT approval is granted, that the Boundary Line Adjustment to dedicate the bus stop land must be recorded before the easement plat associated with the Site Plan can be approved. The easement plat must also be recorded prior to final site plan approval. In consideration is this situation, I will grant one extension as allowed under Section 32.4.3.10 of the Zoning Ordinance to no later than May 29, 2013. I trust this extension will enable you to complete the work necessary to bring SDP201200024 to final approval. Please coordinate with Ellie Ray, the planner coordinating review of this proposal, regarding the submittal of all necessary plats and site plan revisions.
