RE: ZMA200400024 Old Trail Block 13 — Special Exception to waive overlot grading
plan requirement
Dear Mr. Collins:
On November 7, 2012 the Board of Supervisors approved Old Trail Block 13 Special Exception to
waive overlot grading plan requirement by a vote of 6:0 with the following conditions:
1. Garages shall be set back from the edge of pavement of the alley at least seven (7) feet.
2. Driveway grades shall be eight percent (8 %) or less. The grade transition on the driveway
shall not exceed ten percent (10 %).
3. The applicant shall obtain approval of an amended overlot grading plan for each block,
phase, or sub -phase within Block 13 before any permits are issued within Block 13.

RE; Old Trail Village Proffer Waiver Request — Blocks 13A and 13D
Dear Mr, Brooks,
In response to your letter dated October 5, 2012, I offer the following.
Please revise my original, request to be considered a waiver /modification of Proffer 7-
Subsection H, the Overlot Grading Plan, associated with Old Trail Village Blocks 13A
and 13B.
Preliminary subdivision plats were submitted and approved for both Blocks 13A and
13B. In addition to the approved final plats you reference, revised final subdivision plats
were approved and recorded on August 15g' of this year..
The submitted Overlot Grading Exhibit for Blocks 13A and 13B depicts the proposed
revisions to the approved preliminary subdivision plat along with proposed overlot
grading for the Blocks. This exhibit, along with Exhibit A (also submitted) shows the
proposed parking /driveway /garage scenarios for Blocks 13A and 13B,
I did not submit a Certified Engineers Report with the waiver request as I did not see
where it was applicable to the request. County Zoning Ordinance section 18- 4.14.8
requires a Certified Engineers Report for uses of an industrial character prior to issuance
of a zoning compliance certificate: As this waiver request if for a residential use, I did
not see the applicability of the report. If this is incorrect, I can easily and quickly provide
a report addressing the-performance standards of 18 -4.14.
The vicinity map you request was part of my original waiver request, The vicinity map is
shown on the approved Old Trail Rezoning Application Plat submitted with the waiver
request.
ATTACHMENT A
The surveyed boundaries for Blocks 13A and 13B are shown on the submitted Overlot
Grading Exhibit. The lots shown on the exhibit reflect the lots as shown on the approved
final subdivision plats.
Topographic lines shown on the Overlot Grading Exhibit are the proposed grading lines
shown on the approved construction plans for the Blocks. This is noted on the exhibit.
You are correct that there are no streams, stream buffers, steep slopes, floo dplains or
known wetlands on the property. The retaining wall shown on the Overlot Grading
Exhibit is an architectural /landscaping feature less than 4' in height. As the wall is not
located near any of the proposed parking /driveway /garages, I did not see the need to
address it in the waiver request.
You are correct that actual parking /driveways /garages are not shown on the Overlot
Grading Exhibit. Illustrative examples of each are shown on the exhibit. As noted on the
exhibit, final proposed locations will be submitted by individual builders and will be
subject to zoning review as part of the building permit process. The submitted waiver
request letter, along with Exhibit A and the Overlot Grading Exhibit, defines what the
developer proposes for the waiver request with respect to parking/driveway /garages for
single family lots in Old Trail, Exhibit A depicts in detail three scenarios for location of
parking /driveways /garages on each lot. The intent of Exhibit A is to define what will be
allowed with respect to parking /driveway /garages on single family lots.
I feel that a re- examination of the submitted waiver request and attachments, along with
this letter of explanation, satisfies the requirements of section J.
