RE: Old Trail Block 14 (SUB2012 -103) — Request for Authorization of a Private Street and Waiver of
one or more Street Standards along the Private Street
Dear Megan Yaniglos,
I'm writing to request a waiver by the commission for the authorization of private streets in the
development area for the Old Trail Project. The waiver request is consistent with section 14 -233 of the
Albemarle County Subdivision Ordinance under Section 14- 233.A. L(iii) — rear vehicular access to
buildings would be provided so that the buildings may face a common amenity. In Block 14, there are (2)
lots that are being proposed to front on the public park amenity in this section. Two private streets are
being pursued to allow access to these lots from the rear of the parcels and allow the Single Family lots to
front on the Open space within the development. This concept was contemplated in the overall rezoning
of Old Trail, but the details of how these lots would front on these public park and grass mall amenities
and within which sections this would be allowed was not fully vested in the Code of Development.
Therefore, we are requesting this waiver to allow private streets within the Block 14 of Old Trail to allow
these (2) lots to front on the public park. The design of these single family lots fronting on a public
amenity with access through a private street from the rear of the lot is consistent with the development of
other blocks within Old Trail, specifically Block 13 which allows for the same type of condition.
In addition, we are requesting a waiver to the street standards and requirements along these (2) private
streets in Block 14. Specifically, we are requesting a waiver for the planting strips and sidewalks along
Meadow Valley Circle and Claire Mill Circle. The (2) lots, Lot 9 and Lot 12, will have a sidewalk and
tree plantings along the front of the lots within the public amenity Grass mall area and the intent of having
a planting strip, trees, and sidewalks in front of lots in the development area will be achieved with these
features within the public amenity. The private streets that serve as access to the lots will be consistent
with the designs of the other access roads or alleys that serve the units in the Old Trail Development and
provide access to these lots from the rear of the lots. The design of these private streets will also be
consistent with the other private streets within Old Trail. They will have a curb and gutter along the street
(roll top curbing as allowed by Engineering) and allow the drainage to be captured with inlets along the
curb and gutter.
The (2) lots that are being served by the proposed private streets have access to public streets within 110'
from the lot. There are sidewalks that allow public access from the public streets to these (2) lots and
throughout the public amenity open space which enhances the pedestrian system within this block and
connects to the other public trails in the adjacent blocks as well. Drainage structures are being proposed
along the curb and gutter of the private street. Each of these (2) private streets provide access to 10 single
family lots, which equates to less than 100 trips a day on these streets. The design of these lots fronting
on the public amenities allows the principles of the neighborhood model to be more fully implemented
within this section of Old Trail and meet more of the intent of the Code of Development.
We ask that staff and the Commission grant the waivers and authorization for private streets within Block
14 of Old Trail. The principles of Neighborhood design and planning are better met with the proposed
design and these waiver requests.
