This matter came before the Court on the Petition for Writ of Certiorari filed on February
9, 2012, by Petitioners Chris Suh, Anne Suh, HE&J, Inc., a Virginia corporation, Richard
Brown, and Bruce Kirtley pursuant to Va. Code § 15.2 -2314. The Petitioners requested that the
Court review the January 10, 2012, decision of the Board of Zoning Appeals of Albemarle

County, Virginia ( "BZA "), BZA case number AP201100006, upholding the October 11, 2011,
Official Determination by Ron Higgins, Chief ofZoning/Deputy Zoning Administrator required
by Condition 9 of Special Use Permit SP29009.032 (the "Official Determination")
Upon consideration of the return produced by the BZA upon writ of certiorari, pleadings,
the parties' memoranda of law,,the written authorities, and the oral arguments of counsel on
December 10, 2012, and for the reasons set forth in the Court's bench ruling on December 17,
2012, the Court rules that the BZA's January 10, 2012, decision was erroneous.

NOW, THEREFORE, IT IS ORDERED, ADJUDGED, AND DECREED that the January 10,
2012, decision of the Board of Zoning Appeals of Albemarle County, Virginia, BZA case
number AP201100006, is REVERSED, as is the Official Determination. The Clerk is directed to
send certified copies of this Order to counsel of record and pro se Petitioners.

grounds that (1) the Petitioners did not overcome the presumption that the Board of Zoning
Appeals' decision of January 10, 2012 was correct; (2) the Board of Zoning Appeals' decision of
January 10, 2012 was in fact correct; and (3) statements of individual members of the County
Board of Supervisors cannot overrule the plain language of the Board's enactments.

the County. The applicant has not submitted stormwater calculations as of yet but has stated they will
