THIS DEED OF DEDICATION AND EASEMENT, made this 116 day of February,
2013, by and between ELIZABETH T. HOOVER (the "Declarant "), as a grantor for indexing
purposes, and HADEN PLACE, LLC, a Virginia limited liability company (the "Grantee "), as a
grantor and grantee for indexing purposes.
Recitals
A. Declarant is the owner of certain real property located in Albemarle County,
Virginia, shown and designated as TMP 56 -8A (the "Property") on the plat of Dominion
Engineering entitled "Easement Plat Showing New Sight Distance Easement Dedicated To
Public Use On TMP 56 -8A" and dated February 8, 2013 (the "Plat "), which Plat is attached to
and recorded with this Deed of Dedication and Easement.
B. Grantee is the owner of the property designated as TMP 56 -9 on the Plat (the
"Grantee's Property ") which adjoins the Property of Declarant along its northern boundary.
C. As a condition for the final site plan approval for the development of Grantee's
Property, the Virginia Department of Transportation is requiring the _establishment of a sight
distance easement along Haden Lane (State Route 1209) along a portion of the front of the
Property of Declarant as shown on the Plat.

D. Declarant desires to dedicate a sight distance easement to public use as set forth
Dedication and Conveyance
NOW, THEREFORE, in consideration of the premises and the sum of One Dollar
($1.00), cash in hand paid, and other good and valuable consideration, the receipt and sufficiency
of which are hereby acknowledged, Declarant hereby declares and certifies that this dedication is
hereby made in accordance with the desires of Declarant, and Declarant further declares that the
Property is and shall be held, transferred, sold, conveyed and occupied subject to the sight
distance easement as shown on the Plat which is hereby dedicated to public use in order to
satisfy the Virginia Department of Transportation's sight distance requirements. Such easement
shall be located as shown on the Plat over the shaded area of the Property designated as "Sight
Distance Easement (202 SF) ", for the purpose of establishing and maintaining an unobstructed
line of sight along Haden Lane (State Route 1209) at an elevation of no less than thirty inches
above ground level in conformance with the applicable Virginia Department of Transportation
standards. Within the easement area, no structures or plantings shall be placed which obstruct
the line of sight at an elevation of thirty inches or more above ground level. Any plantings
within the easement area shall only be low growing ground cover or dwarf varieties of plants and
shall not exceed twenty -four inches in height.
Declarant reserves the right to place within the sight easement area shrubbery, vegetation,
structures or other facilities consistent with the terms of this sight easement.

These easements and rights expressly include the right to trim, cut and remove trees,
shrubbery, fences, structures and other obstructions within the easement area which exceed the
height of thirty inches.
As a part of this easement, the Grantee and assigns shall have the right to enter upon the
Property within the easement for the purpose of establishing the sight distance easement. If the
Grantee is unable to reasonably exercise the right of ingress and egress over the easement, the
Grantee shall have the right of reasonable ingress and egress over the Property of the Declarant
adjacent to the easement.
The covenants, conditions and agreements of this Deed of Dedication and Easement shall
run with and bind the land, and shall inure to the benefit of and be enforceable by the Declarant
and Grantee, and their respective successors and assigns.
This conveyance is made subject to easements, conditions and restrictions of record in so
far as they may lawfully affect the Property.
