Zoning Administrator Department of Community Development 401 McIntire Road, North Wing Charlottesville, Virginia 22902 -4596 Re:VIO 2013 -018 Tax Map 75 Parcel 50 Amelia, I am writing to follow up on our telephone conversation of March 28, 2013. After examination of the topography around the shed and consultation with a Surveyor, it appears that the shed and the land around it are an inadvertent inclusion in FEMA's designated flood plain. The grade at the shed's foundation is above the Base Flood Elevation and as such it would not be affected by a 100 year flood. FEMA has advised me to request a Letter of Map Amendment (LOMA) from them which will certify that the shed is above the BFE. I have retrained a Surveyor to perform the fieldwork and submit the application to FEMA for their review. I understand that the LOMA application review can take from 30 to 60 days to complete. As I am scheduled to appear before the Board of Zoning Appeals at the May meeting and the LOMA most likely will still be under review by FEMA, I would like to ask that my appearance be rescheduled for the June meeting of the BZA. As I understand it, if the LOMA is issued, this matter will be resolved and my appeal to the BZA will not be necessary. Thank you for your assistance and understanding in this matter.
