Cc: Glenn Brooks Subject: RE: Joynt /Woodson letter Brian, Thanks for sending letter dated June 18, 2014 with sketch with estimates of total disturbed area, volumes of earthwork, and stream buffer impacts associated with two alignments for a proposed (public or private) road on TMP 04200- 00 -00- 00100 (42 -1) to serve TMP 04100 -00 -00 -04600 (41 -46). At present, there is no frontage or access, other than dirt farm field track, to T.M. 41 -46. Ray & Assoc., Inc.) You have explained an anticipated sale of land (for road to be built) to enable T.M. 41 -46 to be subdivided. Engineering is disposed to approve alignment of Road 1 depicted on this sketch, but this alignment proposes two crossings. Code 17- 604.C.7. specifically limits stream crossings to one per lot irrespective of future subdivision, but provides mechanism for approving additional crossings under 17- 604.D. After visiting and photographing site and streams today, in light of estimates submitted in support of proposal, and applying buffer mitigation requirements listed at 17- 604.C.5, which are neither reduced nor waived, if the owners wish to pursue private or public street alignment shown on June 18, 2014 sketch as Road 1, Engineering will approve this alignment provided future subdivision rights of each parcel are protected via Access Easement. Engineering anticipates, as condition of multiple- crossing Road 1 alignment approval, that an easement across (fee simple portion of) T.M. 42 -1 will be granted from (future) owner of this strip to current owner of this strip. Otherwise, by -right development and subdivision of T.M. 42 -1 allowed by underlying zoning is untenable. Please share this information with Applicant, with owners of each parcel, and discuss specifically their willingness to protect future subdivision rights of each parcel through easement. It is imperative in our view that current and future owners retain ability to subdivide to extent permissible by ordinance. Also, as condition of Road 1 multiple crossing approval, if a land transfer is considered, then buffer impact associated with Road 1 alignment, reported to be 0.52 Ac, must be offset by planting 1.04 Ac. Ordinance states that "For stream crossings where any portion of the pre - construction stream buffer is not fully vegetated as determined by the Administrator, and for any portion of a vegetated stream buffer that is disturbed during the installation of the stream crossing, buffer vegetation shall be established and maintained within the stream buffer but outside of the stream crossings at a ratio of two (2) square feet of stream buffer restored for every one (1) square foot of stream buffer that was either not fully vegetated or is disturbed during the installation of the stream crossing. Buffer vegetation shall be established and maintained at the 2:1 ratio to the extent that the stream buffer is fully vegetated outside of the stream crossing, provided that the owner shall not be required to establish vegetation outside of the stream buffer in order to satisfy the 2:1 ratio." (17- 604.C.5.) Engineering stipulates that given existing boundaries and ownership, a transfer of strip of T.M. 42 -1 sufficient for a road/street that may include less land within the buffer than necessary to fully mitigate stream crossing impacts is an option, but this option must include provision to fully mitigate stream buffer impacts due to Road 1, with mitigation occurring within stream buffer on T.M. 42 -1. This is an important consideration. Also please note: Mitigation plantings require bond sufficient to cover plantings and installation of plantings.
