00-02900 and 060AO-09-00-03000
Dear Ms. Schweller:
This letter is to advise you that, based on an inspection of the Old Salem Apartments
(the "Property") conducted on December 1, 2005, and a review of the County's zoning
and building code files regarding the property, we have determined the following:
TMP 060AO-09-00-02200 contains 8.211 acres and 130 dwelling units in 15 structures
that were built in the early 1970s. This parcel is zoned Residential — R15.
TMP 060AO-09-00-02300 contains 6.003 acres and 124 dwelling units in 10 structures
that were built in the early 1970s. This parcel is zoned Residential — R15.
TMP 060AO-09-00-02700 contains 0.054 acres and zero dwelling units. This parcel is
zoned Rural Areas- RA.
TMP 060AO-09-00-02900 contains 1.060 acres and zero dwelling units. This parcel is
zoned Residential — R1.
TMP 060AO-09-00-03000 contains 4.143 acres and 110 dwelling units in 2 structures
that were built in the early 1970s. This parcel is zoned Residential — R15.

The Old Salem Apartments project was developed in accord with a site plan dated April
1969 and amended in January of 1971. At that time all of the referenced parcels were
zoned Residential -R-3. The development is legally nonconforming because it was
developed prior to the adoption on December 10, 1980 of the current Zoning Ordinance
of Albemarle County. The three parcels that are zoned R-15 contain a total of 364
dwelling units on 18.357 acres. This is a gross density of 19.82 dwelling units per acre.
These units are served by 598 parking spaces. The current Zoning Ordinance limits the
density in the R-15 district to 15 dwelling units per acre and requires 2 parking spaces
per unit containing 2 or more bedrooms. The development is also nonconforming to
current R-15 setbacks because Buildings 2625 and 2627 encroach into the current 20 -
foot rear setback. Building 2659 encroaches into the current 15 -foot side setback.
If the development were damaged or destroyed, improvements located on the property
could be reconstructed in the same location and at the same density. Any change in
the present use, structures or site would have to comply with the County's land use
regulations in place at the time of the change.
Structures in the R-15 District are limited to 65 feet in height. The height of the
structures on the property is not known. ,
Parcel 29, zoned R-1, may be developed in accord with the regulations of that district.
Parcel 27, was zoned R-3 when this project was developed. It was not included on the
site plan for this project. The asphalt installed on this parcel prior to 1980 may remain as
a nonconforming element. The fence is permitted in the RA district and may remain on
the property. No other improvements that support the R-15 residential use are permitted
on this parcel.
The site was inspected for compliance with the site plan on December 1, 2005. The
dumpster located on Parcel 27 must be removed or moved to a portion of the site that is
zoned R-15. No other deficiencies were identified
Apart from the dumpster on Parcel 27, there are no outstanding violations of the Zoning
Ordinance or the Building Code.
