Amato (formerly Creech), David James Price and Robert H. Rosenthal, Co-
Trustees of the Henry James Price Irrevocable Trust u/a dated December 1,
1982 (the "Property ")
Dear Mrs. Amato:
You have asked for a letter that provides an analysis of the zoning and other information
regarding the referenced property, located at 2150 Seminole Trail in Charlottesville, VA. This
letter is based on a review of our records. Please be advised of the following:
■ The Property is situated on a parcel of land lying in the County of Albemarle, Virginia,
consisting of 10.0.0 acres of land, more or less, and improvements, identified as Parcel
B on a plat of William S. Roudabush, Jr., Inc., dated October 20, 1977.
The property is zoned Highway Commercial (HC) on the County's official zoning map
and subject to all regulations contained within the Zoning Code regarding
development in the HC district and, thus, is consistent with the current uses of the
Property, which are sales, service and rental of new and used motor vehicles,
including financing of such (the "Current Uses "). The property is also located in the
Airport Impact Area -AIA and in the.Entrance Corridor Overlay District -EC.
■ The site was originally constructed under SDP -288, approved by the Planning
Commission on April 26, 1977. The site has had several amendments with the latest
being SDP - 1994 -62. Property records indicate that the building was constructed in
1978. Therefore, the property is legally non - conforming with respect to Entrance
Corridor regulation which requires a Special Use Permit for outdoor storage.

• Current additions and renovations are taking place in accordance with the plans
approved by the Board of Architectural Review on November 21, 2011. No new site
plan was required. .
• All requirements of the Zoning Code related to ingress and egress from the Property
to a public street have been satisfied. The Property enjoys access onto Seminole
Trail (U.S. Route 29).
• No application for rezoning of the Property, or special permits, conditional use or
variance request in connection with this Property, is now pending.
• There are no open zoning violations for this Property or Current Uses.
■ There are no proffered conditions applicable to or enforceable against the Property
that would prevent use of the Property for the Current Uses.
■ There are no special conditions or time constraints applicable to or imposed on the
Property for the Current Uses.
■ There are no proceedings, pending or threatened, to revoke, rescind, alter, or declare
invalid any laws, ordinances, codes, approvals, permits or certificates applicable to or
issued in connection with the Property by the County of Albemarle, Virginia.
