Dear Weltra Charlottesville Real Estate, LLC:
Mr. Robert J. Kroner, an attorney representing you, has asked for assurance that the Heritage Inn
of Charlottesville Assisted living facility is in compliance with the zoning regulations of
Albemarle County. This letter is based on a review of our records and an inspection of the site.
1. The property is zoned R -15, Residential. Rest home, nursing home, convalescent home,
orphanage or similar institution is a use permitted by special permit in this district. These
institutions are subject to the supplemental regulations found in Section 5.1.13.
2. On June 17, 1992 the Board of Supervisors approved SP -92 -25 with conditions for an
assisted living facility on this property. The conditions included a requirement that the facility
be limited to 80 beds. A copy of the action letter is enclosed.
3. The current, revised site plan for this property was approved on May 4, 1994.
4. A zoning clearance was approved for the assisted care residence, subject to the special permit
and the site plan, on July 2, 1993. A new zoning clearance was approved for change in the
name and ownership of the Assisted Living Facility, subject to the same special permit
conditions, on January 21, 2011. A copy of the latest zoning clearance is attached.
5. The site was inspected on August 15, 2012. No zoning or site plan violations were found
other . than minor discrepancies in the plantings from the original 1992 site plan. Given the
maturity of the plantings and the fact that the plantings meet zoning requirements, this is not
considered to be a violation.

6. A recent survey of the property revealed building corners that are 14.90 feet and 14.86 feet
from the side property line. While the minimum setback for side yards in R -15 zoning is 15
feet, these are off by less than 1 foot and considered to be De minimis. The county does not
pursue such minor discrepencies.
On the basis of this information it is my opinion that the Heritage Inn assisted living facility on
this site is in compliance with the zoning regulations of Albemarle County. Please contact me if

Dear Mr. Gibb:
The Albemarle County Board of Supervisors, at its meeting on June 17,
1992, approved the above -noted request to permit a 23,420 square foot
nursing home on 1,86 acres zoned R -15. Please note that this approval
is subject to the following conditions:
1. Use is limited to 80 beds in the facility;
2. Site shall be developed in general accord with plan prepared by
Raymond E. Gaines, Architect dated March 23, 1992 and revised April
29, 1992.
3. The exteriors of the buildings will be primarily of brick with
earth tones used for roofing and trim.
