Dear Mrs. Tahboub;
In response to your Application for a Letter of Zoning Compliance, this office has
researched your request and offers the following conclusions regarding the
referenced parcel:
• The property was first developed as a 60 bed assisted living facility, and
received a Certificate of Occupancy from the County of Albemarle in
September of 2001. This use was approved by Special Use Permit, SP -1998-
43, on October 21, 1998 by the Albemarle County Board of Supervisors.
• The property is zoned C-1, Commercial. Per Section 22,2.2.6 and 18.2.2.9,
assisted living adult care facilities are allowed in the C-1 District by Special
Use Permit.
• An amendment to the original Special Use Permit, SP -2002-018, to increase
the allowable number of beds on the property from 60 to 90 was approved on
July 3, 2002, which allows the present use.
• The parcel is located within the Airport Impact Area.
• This project was built under a site development plan, SDP -2000-012,
approved on May 19, 2000 and revised on September 25, 2001 and

November 19, 2003. The plan was also amended by SDP -2001-002, which
was approved on February 20, 2001.
• This office has no record of any outstanding zoning violations.
• The property was inspected for zoning compliance on January 11, 2008 and
determined to be in compliance with the approved site plan and Special Permit
conditions.
