HomeMy WebLinkAboutLZC201200025 Correspondence�OF AL VIRGIN P COUNTY OF ALBEMARLE Department of Community Development 401 McIntire Road, Room 227 Charlottesville, Virginia 22902 -4596 Phone (434) 296 -5832 Fax (434) 972 -4126 August 10, 2012 Ms. Raquel White (PZR) c/o Smith Roberts and Associates 100 NE 5th Street Oklahoma City, OK 73104 RE: Barracks West Condominiums (originally known as Old Salem Apartments) 2617 -2699 Barracks Road, Albemarle County, Virginia Letter of Zoning Compliance (LZC201200025 Dear Ms. White: This letter is to advise you that, based on inspections of the Barracks West Condominiums, formerly known as Old Salem Apartments (the "Property "), conducted in July & August of.2012, and a review of the County's zoning files regarding the property, we have determined the following: All of the Property, making up the complex known as Barracks West Condominiums at 2617 -2699 Barracks Road, is zoned R -15 Residential which; permits-apartments, townhouses and condominiums by right at up to 15 dwelling units per acre. 2. The Barracks West development was originally developed as the Old Salem Apartments in accord with a site plan dated April 1969 and amended in January of 1971. At that time all of the Property was zoned Residential -R -3. The development is legally nonconforming because it was developed prior to the adoption on December 10, 1980 of the current Zoning Ordinance of Albemarle County. The parcels that are zoned R -15 contain a total of 364 dwelling units on 18.357 aores. This is a gross density of 19.82 dwelling units per acre, which met the maximum density in R -3 of 20 units per acre, at the time of approval and construction. These units are served by 598 parking spaces. The current Zoning Ordinance limits the density in the R -15 district to 15 dwelling units per acre and requires 2 parking spaces per unit containing 2 or more bedrooms, both conditions are legal nonconforming. Building 2659 encroaches into the current 15 -foot side setback. 3. If the development were damaged or destroyed, improvements located on the property could be reconstructed in the same location and at the same density, provided building permits are obtained within one year. Any change in the present use, structures or site would have to comply with the County's land use regulations in place at the time of the change. 4. Structures in the R -15 District are limited to 65 feet in height. The height of the structures on the property are all less than four stories in height and within the current 65 foot limit. The site was inspected for compliance with the site. plan in July and August of 2012. No deficiencies were identified.
