Burger King Restaurant (the "Project ") —160 Riverbend Drive (the
"Property ")
Dear Ms. Siverling:
In response to a request for a Letter of Zoning Compliance for the above referenced
Property, please be advised of the following:
■ The Property lies within the boundaries of Albemarle County and, as the Chief
of Zoning /Deputy Zoning Administrator for the County I am authorized to
execute this letter.
■ The parcel is zoned Planned Development Shopping Center (PD -SC). The
regulations of the PD -SC zoning district permit eating establishments by- right,
thus the existing use is legally conforming.
■ The parcel is developed in accordance with an approved site plan, SDP1984-
10, as a restaurant.
■ The parking requirement for this restaurant is 35 with two of these to be
spaces for the handicapped. The Project has 41 spaces with two of those
handicapped accessible, thus complying with the parking ordinance.
■ This office has no record of any outstanding violations for the parcel. A site
inspection conducted on June 13, 2012 showed no deficiencies or deviations
from the approved site plan.

In the event of casualty to the Project, in whole or part, the structure may be
rebuilt in its current form (i.e. no loss of sq. footage, with drive - through).
The restaurant was constructed in 1987. A Certificate of Occupancy is not
available for this building. The absence of a certificate of occupancy for the
Project will not give rise to any enforcement action affecting the Project. A
certificate of occupancy for the Project will only be required to the extent of
any construction activity (such as restoring, renovating or expanding the
Project or any part thereof).
■ This project complies with applicable subdivision regulations of Albemarle
County.
■ The current use and improvements for the above parcel are in compliance
with all applicable zoning codes, rules and regulations of the zoning district.
