Maupin, III, Ruby A. M. Debharn & Michael Dean Maupin c/o Michael Maupin) Whitehall Magisterial District Dear Mr. Maupin: This letter replaces my determination of parcel development rights, dated April 23, 2013, based on receipt of new information since that letter was written. The County Attorney and I have reviewed the new title information for the above -noted Property. Our records indicate the above Property contains one dwelling (on the portion indicate herein as "Parcel 76, Lot 2") and is zoned RA, Rural Areas. It is the County Attorney's advisory opinion and my official determination that Tax Map 56, Parcel 76 at 5180 Three Notch'd Road, Crozet in Albemarle County, Virginia is two (2) legally nonconforming lots of record of less than 2 acres each. The sources for this conclusion are as outlined in the tables below: Tax Map 56 Parcel 76, Lot 1 PRIOR TO DECEMBER 10, 1980 Deed Date Parcel Change Description Acres Book/Page Y or N 186/333 4/14/1924 N Conveyed a certain tract or parcel of land containing 1.44 144/100 acres as shown on a plat by Hugh F. Maupin. 1.44 244/314 10/5/1939 N Conveyed same tract to Norma Adams. 1.44 412/248 9/30/1965 N Conveyed same tract to Benjamin C. Fleming and 1.44 Odell M. Fleming, his wife. This was the last deed recorded prior to December 10, 1980 and establishes TMP56-76, Lot 1 as a parcel of record rior to December 10, 1980. If you are aggrieved by this determination, you have a right to appeal it within thirty days of the date notice of this determination is given, in accordance with Section 15.2-2311 of the Code of Virginia. If you do not file a timely appeal, this determination shall be final and unappealable. An appeal shall be taken only by filing with the Zoning. Administrator and the Board of Zoning Appeals a notice of appeal which specifies the grounds for the appeal. An appeal application must be completed and filed along with the fee of $240.
