NOTICE TO COMPLY
Dear Mr. Ray:
Under Section 17 -213, of the Albemarle County Code, this is your NOTICE TO COMPLY with the requirements of
the Erosion Control Permit for the referenced property and to immediately take corrective measures that address the
erosion and sediment control deficiencies on this property. The specific deficiencies and measures required to
correct those deficiencies are as follows:
1. Deficiency: Silt fence requires maintenance throughout project.
Required Corrections: Install and maintain silt fence in accordance with 3.05 of the VESCH,
Third edition, dated 1992.

Deficiencv: Building pad has not been temporarily seeded.
Required Corrections: Temporary seed building pad in accordance with 3.31 of the VESCH,
Third edition, dated 1992.

V'e Required Corrections: Complete SWM pond in accordance with the approved plan.
4. Deficiency: Stream crossing is in need of cleaning.
Required Corrections: Maintain stream crossing in accordance with 3.24 of the VESCH,
Third edition, dated 1992.
v 5. Deficiency: Zone A has not been stabilized.
Required Corrections: Temporary seed zone A in accordance with 3.3I of the VESCH, Third
edition, dated 1992.
6. Deficiencv: Zone A has exceeded the limits of disturbance.

7. Deficiency: Drop inlet protection has not been installed throughout project.
Required Corrections: Install Drop Inlet Protection in accordance with 3.07 of the VESCH
Third edition dated 1992.
8. Deficiency: Sediment trap in Zone A is inadequate for drainage area.

Required Corrections: Install RWD in accordance with 3.11 of the VESCH Third edition
dated 1992.
0. Deficiency: Slopes throughout project do not meet 2:1 county standard or stated plan for Zone

Required Corrections: Grade slopes to minimum or approved plan standards in accordance
with VESCH Third edition, dated 1992.
11. Deficiency: Construction entrance for area Zone A has not been installed.
Required Corrections: Install construction entrance in accordance with 3.02 of VESCH Third
edition dated 1992.
12. Deficiency: Channel at end of temporary fill slope has not been shaped properly.
Required Corrections: Shape channel for positive drainage.
13. Deficiency: Construction road stabilization has not been applied in zone A.
Required Corrections: Install construction road stabilization in accordance with the approved
E &S plan.
14. Deficiency: Topsoil pile not stable.
Required Corrections: Seed or provide sediment trapping measures in accordance with the
VESCH Third edition dated 1992.

"Permanent vegetation shall be installed on all denuded areas within nine (9) months after the date the land
disturbing activity commenced, excepr for areas that the program authority finds are necessary parts of the
construction that are subject to an active building permit and areas where erosion is prevented by a non - erosive
surface. For the purposes of this section, a "non- erosive surface" includes, but is not limited to, roadways and
sidewalks covered by gravel, asphalt pavement, or concrete; trails or paths covered by gravel, stone dust, or mulch;
buildings and other permanent structures; and such other surfaces that the program authority determines would
adequately provide a permanent barrier to erosion. "

Unless subsequently amended in writing by this office, it is expected all of these corrective measures will be
completed by no later than December 21, 2412.
Under Sections 17 -213, 214 and 215 of the Albemarle County Code, failure to make these corrections by the
required date can have the following results:
• Your permit may be revoked.
• You may be required to submit a new Erosion and Sediment Control Plan and have it approved before
additional land disturbance will be allowed. Review of a new plan can take up to 45 days for each submission
and it is not unusual for several submissions before the plan can be approved. This requirement would include
a new application, fee and bond for the work proposed under the plan.
• The County may issue a STOP WORK ORDER and seek relief in the Circuit Court. The Circuit Court can fine
the property owner up to $2,000 per violation, convict the property owner of a Class 1 misdemeanor and require
the property owner to pay any damages resulting from a failure to comply with this notice. Should you have a
legitimate reason you can not complete the corrective measures by the above given date, you must immediately
contact me at (434) 296 -5832. Unless you have contacted us and alternative arrangements have been agreed to
in writing, we will expect the corrections to be completed by the above date.

Required Corrections: Remove sediment in accordance with 320 of the VESCH, Third edition,
dated 1992.
