WHEREAS, the Albemarle County Zoning Ordinance includes regulations pertaining to the
regulation of noise; and
WHEREAS, it may be desirable to amend the noise regulations in the Zoning Ordinance to
better distinguish which sounds are regulated under the Zoning Ordinance and which sounds are
regulated under the noise regulations in Chapter 7 of the County Code, and to eliminate any perceived
overlap between the two; and
WHEREAS, it also may be desirable to amend the noise regulations in the Zoning Ordinance
to update the language of the exemptions in County Code § 18- 4.18.05 so that it is consistent, to the
extent possible, with the language of the exemptions in County Code § 7 -106.
NOW, THEREFORE, BE IT RESOLVED THAT for purposes of public necessity,
convenience, general welfare and good zoning practices, the Albemarle County Board of Supervisors
hereby adopts a resolution of intent to consider amending Albemarle County Code § 18 -4.18, Noise, and
any other sections of the Zoning Ordinance deemed to be appropriate to achieve the purposes described
herein; and
BE IT FURTHER RESOLVED THAT the Planning Commission will hold a public hearing on
the zoning text amendment proposed pursuant to this resolution of intent, and make its recommendations
to the Board of Supervisors at the earliest possible date.
