BACKGROUND: The subject parcel, Tax Map 32 Parcel 38A, contains approximately .914 acres
and is located on U S Route 29N (Seminole Trail) in the Rivanna Magisterial District, and is zoned
C-1, Commercial (Attachment A). The Site Review Committee has reviewed the major site plan
amendment (SDP 02-062) for compliance with and existing special use permit (SP-89-27) and the
Zoning Ordinance and has identified that modifications are required to allow one-way circulation,
and angular parking. With Planning Commission approval of all modifications, the major site plan
amendment may be approved administratively. (Attachment B)
DISCUSSION:
Request # 1 One-way Circulation
Section 4.12.6.2 of the Zoning Ordinance states, "One-way circulation aisles shall not be permitted,
except that the Commission may approve one-way circulation in such case where the same is
necessitated by the peculiar character of the site..." The applicant is requesting permission to
provide one-way circulation around the entire building. (Attachment C) Engineering and Planning
staff are of the opinion that the signage, along with proper pavement markings, would be effective
in promoting safe traffic patterns. Therefore, staff recommends approval of the modification to allow
the proposal for one-way circulation (Attachment D).
Request # 2 Modification for angled parking
Section 4.12.6.5 (c) of the Zoning Ordinance states, "Where practical considerations warrant, the
Commission may authorize other angled, curvilinear, and/or parallel parking." In accordance with
this section, the dimensions for the angled parking spaces shall be reviewed and approved by the
Director of Planning and Community Development. The applicant is requesting approval of a
modification to allow the use of thirteen (13) angled parking spaces at the front of the existing
building. (Attachment B) Engineering Department staff has no objections to the angled parking
space configuration proposed with the plan that meets the County's minimum requirements for size.
Therefore, staff recommends approval of the angled parking space configuration (Attachment D).
RECOMMENDATION: With the support of the Engineering Department, Planning staff
recommends approval of the applicant's requests to allow of one-way circulation and angled parking
with the following condition:
Relocate the southern directional pavement marking eastward so it is nearer the site
entrance (adjacent to the handicapped parking stall). This, with the eastern pavement
marking as currently shown on the plan, will provide a clearer indication of on -site
circulation for motorists.

Re: Terry Property
Dear Francis:
Mr. Joseph Terry would like to request a waiver of the requirement for traffic
flow and parking on his parcel (TMP 32, parcel 38A). Due to the shape of his
parcel, building location, and the type vehicles (some 16 ft. trucks) in his rental
business it would best serve to have one-way traffic flow around the office
building' and the vehicle parking spaces at an angle to his bank. With this
arrangement he does not have enough travelway width to provide two-way traffic
flow. If perpendicular parking is required, the travelway would be even narrow and
it would impossible to park the 16 ft. trucks.
It is my opinion that one-way traffic flow and angular parking is the best solution
and does not pose a problem with regard to public health, safety or welfare. In
addition emergency vehicles can best operate with the one-way traffic flow and
angular parking. Since the waiver conditions are presently in place and has been
for some time, it demonstrates and has been demonstrating that these are the
best arrangements.
Your approval of this waiver would be greatly appreciated.
