Albemarle County Virginia (the "Property")
Mr. Hendricks:
You have requested written determination to confirm the permitted uses on the
aforementioned property. The current use of the building includes both residential
and commercial office units. In response, please be advised that:
The Property is zoned Neighborhood Model Development ("NMD"), and is subject to
ZMA2002-2 dated August 5, 2003 and a Code of Development ("COD"), dated June
10, 2003. The approved COD allows 84,000 square feet of commercial space
and/or a maximum of 70 residential units. The residential units are permitted to be
rented.
The current development was originally built under a site plan, SDP2006-50
approved February 16, 2007 and subject to a subdivision plat, SUB2006-191, dated
December 28, 2006. The site plan permitted 56 units with certain commercial
square footage located on the first floor. According to the COD, 14 additional units
are permitted and there is no obligation to provide either a minimum or maximum
commercial square footage.
Currently, a 25% shared parking reduction has been approved for the existing site
plan. Should additional residential units be constructed, a total of 86 parking spaces
are required under the zoning ordinance.
If you are aggrieved by this determination, you have a right to appeal it within thirty
days of the date notice of this determination is given, in accordance with Section
15.2-2311 of the Code of Virginia. If you do not file a timely appeal, this
determination shall be final and unappealable. An appeal shall be taken only by
filing with the Zoning Administrator and the Board of Zoning Appeals a notice of
appeal which specifies the grounds for the appeal. An appeal application must be
completed and filed along with the fee of $240. The date notice of this determination
was given is the same as the date of this letter.
