Charlottesville, VA 22911 RE: SP 2010000042 David Brown Auto Detailing & Repair TAX MAP/ PARCEL: 062000000076A1 Dear Mr. Brown: Fax (434) 972 -4126 This letter is intended to clarify the requirements for the lawful operation of a public garage with auto detailing and repair on Tax Map Parcel 06200- 00- 00- 076A1. Although the Albemarle County Board of Supervisors took action to allow a public garage on the property, the use may not lawfully begin until all of the conditions of the special use permit have been met. The conditions of Special Use Permit 2010 -42 were originally outlined in a letter dated July 13, 2012 (attached). Please be advised that the following conditions must be satisfied no later than October 15, 2013 or a Notice of Violation will be issued. This deadline may be extended at the discretion of the Zoning Administrator provided that you are proceeding in good faith and can demonstrate a justified cause for the extension: Condition 3 — Compliance with Virginia Department of Health Regarding Water Supply & Septic System In addition to being a condition of your special use permit, Health Department approval is required prior to the County issuing a zoning clearance. According to the Health Department, in order to get approval you will have to uncover the following components for them to evaluate: sewer line between the garage and the existing septic tank, the septic tank, and the distribution box. You will also have to apply for a septic modification permit for the sewer line between the garage and the existing septic system. Condition 8 — Landscaped Buffer Adjacent to Stream This condition requires that a minimum 20 foot buffer area adjacent to the stream be planted with native tree and shrub species at a density specified in the Riparian Buffers Modification & Mitigation Guidance Manual. The attached concept plan shows the area to be planted highlighted in orange. At a minimum, this buffer area should be planted with the following, selected from the attached plant list: 5 canopy trees @ 1 '/2 inch — 2 inch caliper or large evergreen @ 6 feet; and 10 understory trees @ 3/4 inch -1 '/Z inch caliper or evergreen @ 4 feet; and 15 small shrubs or woody groundcover @ 15 -18 inches A zoning clearance will not be issued until the installation of all required landscaping is complete. Please contact us as soon as these plantings are installed so we can conduct a site visit to sign off on this requirement. Condition 12 — Approval from the Department of Environmental Quality Approval from the Department of Environmental Quality is not required; however, it is expected that any activities occurring on site will be compliant with state environmental regulations. All conditions of your special use permit must be met before the County can issue a zoning clearance.
