Dear Mr. Schuck:
This is a letter of intent signifying that, as the manager of the Liberty Land LTD, I will be
working with the Hurt Investment Company to arrange the necessary off-site access, grading,
and/or sight-line easements to the Hurt Investment Company in order to facilitate the
construction of a water line and a private road that will serve the proposed Ashcroft West
Subdivision. The Ashcroft West private road will align with terminus of Summit Ridge Trail.

Dear Mr. Pennock:
In accordance with Section 14-234 of the Albemarle County Code, we respectfully
request authorization to construct private roads on the subject parcel.
This request concerns the PRD section of Ashcroft West only. Any other development
on this parcel shall be considered separately.
We are submitting this request under the "General Welfare" provision for private road
consideration as described in Section 14-232.A.3.
There are two potential means of access to this PRD, as approved by the Board of
Supervisors in ZMA-94-16: "through either the Franklin or Ashcroft development." The
proposed means of access is through Ashcroft. Access through Ashcroft requires
connection to an approved private road, Summit Ridge Trail, which in turn connects to
an approved and established private road, South Lego Drive. South Lego Drive
becomes a public road near the Ashcroft clubhouse. As a private road, South Lego
Drive was designed, approved and constructed with a section of 16% grade, which
meets private but not public road standards. Likewise, the portion of Summit Ridge Trail
that has been constructed contains a 12% grade, higher than the maximum of 10%
allowed for a public road. To bring these roads to public standards now may not be
possible, as homes are established accessing these roads.
The other potential means of access, through Franklin, would involve traversing a
significant steep hillside, creating unnecessary land disturbance.

In allowing private roads in Ashcroft West with the currently proposed access through
Ashcroft, the general welfare is served by keeping the roads in Ashcroft as they are
currently build, as well as by avoiding unnecessary grading through the RA-zoned
section of the proposed Lake Ridge development.
To address the requirements of Section 14-234.C, we submit that:
1. The road will be designed to carry the anticipated traffic volume of 280 VPD;
2. The Comprehensive Pan does not provide for a public street in the approximate
location of the proposed private road;
3. The private road will be owned by the owners' association, subject to an
easement as indicated on the Preliminary Plat;
4. The private road will not serve through traffic nor intersect the state highway
system in more than one location; and
5. Flood hazard overlay district requirements do not apply.

This letter is to notify you that the development proposal referenced above will be heard by the Albemarle
County Planning Commission on May 1,2007,at 6:00 p.m. in the Lane Auditorium of the County Office
Building, 401 McIntire Road in Charlottesville,VA. This petition is described as follows:
■ SUB 2006-375 Ashcroft West—Preliminary Plat
Request for re-approval of a preliminary plat to allow the creation of 28 new lots. The property is
described as a portion of Tax Map 78 - Parcel 57, which contains 253.7 acres zoned R-1
(Residential), RA (Rural Areas) and PRD (Planned Residential Development) adjacent to the
Franklin, Ashcroft, Fontana, and the proposed Lakeridge subdivisions. This site is located in the
Rivanna Magisterial on the PRD portion of the parcel and proposed access is from the east
through the Ashcroft subdivision. The Comprehensive Plan designates this property as being
split between Neighborhood Density in Development Areas Neighborhood 3 and Rural Area 2.
The applicant or applicant's representative is requested to be present at the Planning Commission
meeting. The applicant will receive a tentative agenda and staff report approximately one (1)week prior
to the Planning Commission meeting. The tentative agenda and staff report will also be available for
review by the public during this time in the Department of Community Development during business
hours(8 a.m. - 5:00 p.m. Mon-Fri). To assure the information is ready for your viewing and to allow staff
to be available to help with any questions,we encourage you to schedule a viewing time. Please call 296-

RE: TM 78 P 57 (Ashcroft West); Request for Private Roads (revised)
Dear Mr. Waller:
In accordance with Section 14-234 of the Albemarle County Code, we respectfully request
authorization to construct private roads, built to VDOT Mountainous Terrain standards, on the
subject parcel. This request concerns the PRD section of Ashcroft West only. Any other
development on this parcel shall be considered separately.
We are submitting this request under the provisions of Section 14-232.A.1 and Section 14-
232.A.4. 14-232.A.1 allows for authorization of private roads "to alleviate significant degradation
to the environment" if four conditions are met:
(i) if the property is within either the rural areas or village residential zoning districts—
although the property is zoned PRD, it is within the rural areas district and the rural
area Comprehensive Plan designation.
(ii) the private roads will alleviate a clearly demonstrable danger of significant
degradation to the environment of the property or any land adjacent thereto which
would be occasioned by the construction of a public street in the same alignment—
as indicated with the previously submitted exhibits and calculations, and in
accordance with subsection (a), the "total volume of grading for construction of a
public street would be thirty (30) percent or more than that of a private road in the
same alignment." The actual figure is nearly 500% more grading if Lego Drive is
included; 93% without considering Lego Drive.
Please note that while the basis for the cross sections shown on the previously
submitted exhibits is aerial topography also shown on the exhibits, we respectfully
submit that the topographic map was created to meet accuracy standards similar to
that of a field survey and thus meets the spirit of the "field-run" cross section
requirement of the Ordinance.
(iii) no alternative public street alignment is available which would alleviate significant
degradation of the environment—While other locations are possible for the road, it is
constrained to be at or near the ridgetop by the topography on each side, and any
road in the same general vicinity would have a similar difference in earthwork
volumes.

Section 14-232.A.4 allows for authorization of private roads "if the general welfare, as opposed
to the proprietary interest of the subdivider, would be better served by the construction of one or
more private roads than by the construction of public streets." In this case, the general welfare is
served by not requiring a modification to Lego Drive to public road standards. Since Summit
Ridge Trail connects to a private Lego Drive, Summit Ridge Trail cannot be made public unless
the private portion of Lego Drive is made public. VDOT has indicated that it will not accept the
private portion of Lego Drive into the road system as it is currently built; moreover, bringing
Lego Drive to public standards would involve significant clearing, grading, utility and driveway
relocations, and disturbance of private property outside of the existing easement.
Although different alignments may be available for Summit Ridge Trail, possibly resulting in
variations in earthwork quantities, the principal reason for requesting private roads in Ashcroft
West is based on the connection of Summit Ridge Trail solely to another private road, Lego
Drive. This is in accordance with the approval of ZMA-94-16 amending the PRD allowing access
through Ashcroft. Additionally, the approval of private roads will allow the developer to provide
more innovative water quality facilities than would be allowed if the road were public; there is the
opportunity, within a private road easement, to provide such measures as flat-bottom ditches
and water quality landscaping. This opportunity is not available within a public road right-of-way.
In a letter dated 13 October 2004 from Allan Shuck to Stephen Waller, Mr. Shuck states, "It also
appears that the private road section of Lego Drive can be upgraded (with allowance of the
vertical grade and replacements of wooden guardrail with VDOT standard guardrail) to meet
VDOT road standards. While such a road may meet VDOT standards for pavement thickness,
VDOT has indicated that the existing road grade is an obstacle to accepting the road into the
state system.
To address the requirements of Section 14-234.C, we submit that:
1. The road will be designed to carry the anticipated traffic volume;
2. The Comprehensive Plan does not provide for a public street in the approximate location
of the proposed private road;
3. The private road will be owned by the owners' association, subject to an easement as
indicated on the Preliminary Plat;
4. The private road will not serve through traffic nor intersect the state highway system in
more than one location; and
5. Flood hazard overlay district requirements do not apply.

Dear Mr. Waller:
In accordance with Section 14-234 of the Albemarle County Code, we respectfully request
authorization to construct private roads, built to VDOT Mountainous Terrain standards, on the
subject parcel. This request concerns the PRD section of Ashcroft West only. Any other
development on this parcel shall be considered separately.
We are submitting this request under the provisions of Section 14-232.A.1 and Section 14-
232.A.4. 14-232.A.1 allows for authorization of private roads "to alleviate significant degradation
to the environment" if four conditions are met:
(i) if the property is within either the rural areas or village residential zoning districts—
although the property is zoned PRD, it is within the rural areas district and the rural
area Comprehensive Plan designation.
(ii) the private roads will alleviate a clearly demonstrable danger of significant
degradation to the environment of the property or any land adjacent thereto which
would be occasioned by the construction of a public street in the same alignment—
as indicated with the previously submitted exhibits and calculations, and in
accordance with subsection (a), the "total volume of grading for construction of a
public street would be thirty (30) percent or more than that of a private road in the
same alignment." The actual figure is nearly 500% more grading if Lego Drive is
included; 93% without considering Lego Drive.
Please note that while the basis for the cross sections shown on the previously
submitted exhibits is aerial topography also shown on the exhibits, we respectfully
submit that the topographic map was created to meet accuracy standards similar to
that of a field survey and thus meets the spirit of the "field-run" cross section
requirement of the Ordinance.
(iii) no alternative public street alignment is available which would alleviate significant
degradation of the environment—While other locations are possible for the road, it is
constrained to be at or near the ridgetop by the topography on each side, and any
road in the same general vicinity would have a similar difference in earthwork
volumes.

5. The applicant needs to provide a letter of intent from the offsite property owners before the preliminary
plat can be recommended for approval. This is needed for the access to the subdivision and the
proposed utilities. [Design Manual 1101]
6. Please provide conceptual stormwater management for the entire subdivision. This has not been
adequately addressed with the preliminary plat: [14-302A13, 14-305A]
(a) The applicant needs to submit the BMP removal rate computations.
(b) Stormwater management facilities shall be sited to capture,to the maximum extent practical,
the runoff from the entire land development project area. A SWM facility is going to be
required for the impervious areas located around Lots 17-28.
(c) The locations of the SWM facilities need to be as far removed as possible from the buildable

rectangle inscribed within the building site.
5. [S.O. 14-302.0]Provide a statement of the right of further division for the 21.25 acre residue parcel with
the Rural Areas zoning designation. Based on the proposed development of Lake Ridge,there are nor
development rights remaining in that portion of the residue.
6. [PRD.#5]A private road serving only the lots in Ashcroft West, as proposed in the previously reviewed
preliminary plat,would require Planning Commission approval. However, in accordance with conditions
of the re-zoning,the proposed connector between Franklin to Ashcroft shall be designed as a public
