ATTACHMENTS: Yes The request includes grades of up to 12%. REVIEWED BY: VWC STAFF CONTACT(S): Margaret Doherty BACKGROUND: The subject property is under construction for two retail buildings of approximately 7,500 square feet each. A Temporary Certificate of Occupancy was issued pending approval of the site plan amendment. The Site Review Committee reviewed the amendment request(SDP 00-153) and identified that a waiver of the maximum parking lot slope is required. With Planning Commission approval of this waiver, SDP 00-153 can be approved administratively. DISCUSSION: Section 4.12.6.3 (b), Minimum Improvements, states: "Maximum grade for parking spaces, loading spaces, and access aisles abutting parking or loading spaces shall not exceed five (5)percent and cross slope grade shall not exceed two (2)percent." The proposal includes grades ranging from 5.2% to 12% over two small areas near the middle of the site (see Attachment B). The Applicant's explanation of how the grades were constructed is attached(Attachment C). Although these grades far exceed that permitted by the code, staff believes that the proposed grades do not create a hazard, nor result in an inferior design. Only 4 parking spaces will have slope grades over 5%. The steeper grades are located within the drive aisles,where users of the site will not be getting in and out of their cars. The Engineering Department reviewed the waiver request and found that the proposed grades do not appear to present a danger to safety and welfare (see Attachment D). Therefore, staff finds no conflict with these requests, and recommends approval of the parking modifications. RECOMMENDATION: Planning hereby recommends approval of the Seminole Commons at Forest Lakes Site Plan Amendment Parking Lot Slope Waiver Request to allow the maximum grade of the parking lot to exceed that permitted by Section 4.12.6.3(b). Dear Members of the Planning Commission: In conjunction with the site plan amendment for Seminole Commons, where on sheet 2A/6 two shaded areas are shown that do not conform to the code requirements for parking lot slopes, I am hereby requesting that a waiver be granted to allow the grades as shown. For both shaded areas, the limit of the paved condition is shown, indicating that almost the entire area of the request is in a paved and nearly completed condition. Previously I met with the engineering and planning department and have since furnished engineering with a letter of explanation of the circumstances surrounding this situation. Our attempts, despite a plan revision to raise the northern building pad, were to maintain parking lot grades within the code requirement. However, minor adjustments to the proposed grades during the construction process led to the increased slopes in question. Because the adjustments took place in small areas, they created a greater impact to the grade percentages. The areas in question are small. They are arguably not noticeable and do not create safety or practical problems. Your consideration of this waiver request is appreciated. Dear Glenn: When the Seminole Commons site plan process originally started, Shields Development Corporation owned TMP 32-41 H1 and TMP 32-37A1. At that time, a site plan for storage units was being prepared by Civil Engineering, Inc. (Brian Smith, P.E.) on TMP 32-41 H 1 and was substantially complete. Upon embarking on the Seminole Commons Site Plan, it was recognized that some type of slope easement or retaining wall solution woulr' be needed to accommodate grade changes between the two sites. Several slope adjustments were made to accommodate this with one of the main changes being to install foundations on the two southern most storage units, that would act as retaining walls and allow grade changes along the sides of the buildings without undermining the building foundations. Unfortunately, during the construction process, this detail was somehow overlooked and the two buildings were constructed with minimal foundations, not allowing grade changes to the sides of the buildings. This fact became obvious when Seminole Commons parking lot was being graded and the lack of foundations for the two buildings became apparent. Beyond this explanation, it is difficult to speculate on the breakdown in communication during the construction process, since we were not directly involved. Relative to the increased parking lot grades, several factors contributed to this situation, starting with late site plan changes to the northern building. An increase to the size of the building occurred very late in the review process,just after the Valente's purchased the northern parcel (TMP 32-37A1) from Shields Development Corporation, and after Arthur Valente had gained approval from ARB for the larger footprint. We subsequently made the change on the site plan, and the plan was approved by the Planning Department. Valente's architect, Arthur Valente, was apparently planning to use the same basic front, rear and side elevations on the north building as on the south building, multiple entrances across the entire front and rear of the building and slab on grade construction. However, the grades on the parking lot and along the northern end of the north building created a problem for this design, since a portion of the finished floor elevation on the northern end would be below grade and require some external wall waterproofing and limit the number of entrances on the northern end of the building. These were problems that Shield's architect indicated he would design for, but that perhaps due to the late property transfer between Valente and Shield's, went unnoticed. During the construction process, after the building was staked out, it became apparent that with the number of entrances planned along the front and rear of the building, and the need to keep the building floor elevation above grade, the building floor elevation needed to be raised in order to accommodate this situation. 4 Page 1 of 2 The possibility of raising the floor elevation of the north building one foot was looked at in conjunction with maintaining grades in the parking lot such that the parking bays would stay under 5% and the travelways would stay under 10%. After looking at this situation, we furnished Jo Higgins, the Valente's construction manager, and the Valentes a worksheet which showed this to be possible by adding steps to the front walk. As a result,Jo Higgins told us to go forward with this change and she would pursue an amendment request. During the construction of the parking lot, we staked the lot according to the revised plan that Jo Higgins turned in with the amendment request. Whether Dillard made some adjustments to the grades, I do not know. However, because the plan was "tight" in respect to the desired grades, and because a relatively slight adjustment in a small area could produce a several percentage difference over a small distance, there are several resulting areas where the as built parking lot grades exceed the grades required by the ordinance. In summary, the Seminole Commons Site Plan has been difficult for a number of reasons. However, the biggest obstacle has probably been the intensity of development for the size of the site. This situation invariable increases the risks for problems to occur. The problems in this case tended to be site problems and I think the attempts to deal with them were reasonable. With this in mind I am hopeful the amended site plan can be approved. Your consideration is appreciated. The Engineering Department can recommend approval when the following items are satisfactorily addressed: 1. The constructed retaining wall shown on this revision (sheet 3/6) exceeds 5 feet in height from the toe, and receives loading from the adjacent building foundation, and so requires plans and computations certified by a professional engineer. 2. Permission is required from off-site property owners for construction and permanent improvements where the 1.5:1 slope is proposed. 3. Please provide more information regarding the request for the slope on adjacent property to exceed 2:1 (the Engineering Department policy limit on steepness of slopes for surface and_ structural stability). Measures that have been discussed with the applicant are: - permission from off-site owners as in comment 2 above - landscaping plan to follow E&S Stnd. & Spec. 3.37 (provided on sheet 2B/6) - certification of structural stability by a Professional Engineer - diversion or piping of drainage from roof downspouts as depicted on approved plans. The request received with this revision for a waiver of section 18-4.12.6.3 regarding the grades in parking areas has also been reviewed. Please refer to the justification letters submitted by the applicant, which are attached. The site plan amendment confirms that the parking area slopes in some areas well exceed the requirements of the Zoning Ordinance. However, the constructed grades in the parking area do not appear to present a danger to safety and welfare. As indicated in previous correspondence, the dumpster access for service vehicles is obstructed by parking spaces. This requires access to be managed by operation and pickup times. In general,the Engineering Department prefers not to rely on operational measures to address site circulation concerns. Please contact me if you have questions.
