shown.

The properties, described as Tax Map 62A1 - Section 2 - ACTION: Yes INFORMATION:
Parcels 4 and 5, and Block B -Parcel 13, are located in the Rio
Magisterial District on the south side of Rio Road [Route 631],
at the intersection with Wakefield Road(Attachment A). The ATTACHMENTS: Yes
Comprehensive Plan designates this property as Urban Density
in Neighborhood 2.

BACKGROUND: At its December 5, 2001 meeting, the Board of Supervisors approved a Zoning Map
Amendment allowing the rezoning of the subject property from R-2 to R-6,with proffers,to allow the proposed
mixed-use development(Attachment B). This action was taken with an additional allowance for a reduction
in the number of required parking spaces, by allowing a cooperative parking arrangement between the
residential and commercial uses based on the times when each are expected to experience peak demands. Staff
granted administrative approval of the preliminary site plan,which also serves as the proffered application plan,
on January 8, 2002 (Attachment C). Staffs review has determined that the tentative site plan is in accordance
with the approved application plan. However, during the review of this final site plan, the Site Review
Committee (SDP 02-030) identified that a modification is required to allow a reduction in the number of
loading spaces. With Planning Commission approval of the requested modification,the preliminary site plan
can be approved administratively.
DISCUSSION:
Reduction of Required Off-Street Loading Spaces:
Section 4.12.6.2 of the Zoning Ordinance requires one off-street loading space for each 8,000 square feet of office
space. Under these provisions two loading spaces would be required for the proposed 17,500 square feet of office
space in this development. Section 4.12.7.6 allows the Planning Commission to modify the loading space
requirements,provided that the public interest, safety and sound engineering practices are not compromised. The
applicant has submitted a request for a modification to eliminate the loading space requirements,indicating that
the addition of loading spaces could necessitate alteration of the application plan including a probable reduction
in the number of residential units allowed. The applicant's justification further indicates that due to the limited
amount of commercial space allowed in this development deliveries to the site are likely to be infrequent and
should be accommodated by the parking spaces that are left vacant during daytime business hours.

In accordance with Section 4.12.7(d),off-street loading spaces shall be a minimum of 12 feet in width and 25 feet
in length, which is intended to ensure the provision of adequate space for the largest sized delivery trucks.
Loading spaces of this size are often located at the sides of buildings to allow a separation from the regular
business-related traffic. Staff is of the opinion that the types of businesses located at this site would be limited
by the relatively small amount of office space provided as well as the proffer that is intended to restrict the
commercial uses to those that don't have high parking demands. Furthermore,because of the limits on the sizes
and character of those businesses, staff expects that most deliveries will be made in smaller vehicles that only
need to visit the site briefly, as opposed to those that would need the maximum amount of space. It is likely that
these vehicles would usually be parked in the regular parking spaces that provide the most convenient to the front
entrance.
Staff also gives consideration for the fact that Section 4.12.6.5(d) allows a reduction in the standard parking stall
length(from 18 to 16 feet)with a 2-foot overhang,provided that the 24-foot aisle width is maintained and that
those 2 feet do not extend over sidewalks. In reviewing this particular request staff recognizes that the sixteen
(16) spaces in the northern section of the parking lot,near the commercial office buildings, are 18 feet in length
and have at least 4 feet of additional space extending over grass that would be allowable for overhang. Although
a majority of the deliveries expected for this site should be accommodated sufficiently with the standard-sized
parking spaces,the additional overhang would be useful on the occasions that any larger vans delivery vans were
to visit the site. Therefore, staff supports the modification to allow an elimination of the required number of
designated loading spaces,with a condition that would require the installation signage to direct delivery vans and
trucks to the upper lot, closest to the entrances of the commercial buildings.
RECOMMENDATION: Planning staff hereby recommends approval of a modification eliminate the loading
space requirements, with the following condition:
The applicant shall install proper signage to direct any large-sized delivery vans and trucks to the
northernmost portion of the parking lot where the area allowing parking overhang is shown.

3.15 Acres to be rezoned from R-2 and R-6 to PRD
Pursuant to Section 33.3 of the Albemarle County Zoning Ordinance, the owner, or its duly authorized
agent,hereby voluntarily proffers the conditions listed below which shall be applied to the property, if
rezoned. These conditions are proffered as a part of the requested rezoning and it is agreed that: (1) the
rezoning itself gives rise to the need for the conditions; and (2)such conditions have a reasonable relation
to the rezoning request.
1. The development on Tax Map 62A1 Parcels 2-4, 2-4A,2-5, and 2 (B) 13 shall be in general accord
with the plan produced by Daggett and Grigg Architects, titled"Rio Square Preliminary Site Plari"
(title sheets and sheets C-1, C-2, C-3, C-4, L-1, and A-1), dated July 16, 2001 and last revised on
August 20,2001. On Sheet A-1, the relative location and massing of the structures, landscaping, the
building roof lines, and roof pitches are proffered as part of the Application Plan for ZMA 01-03.
Final design details such as materials,jack arches, types of windows and first floor master bedrooms
are not proffered. No building construction shall begin unless and until the Design Planner determines
that the architecture is in general accord with sheet A-1 of the Application plan..
2. The owner may vary the square footage of office use or the number of townhouse units on the
Application Plan;however, footprints of the buildings and uses within the buildings shall be in general
accord with the Application Plan and the parking provided for the office use shall be not less than 90%
of the parking spaces required for that use, and the parking provided for the townhouse dwelling units
shall be not less than 40%of the parking spaces required for that use, as these uses are defined in
Section 4.12 of the Albemarle County Zoning Ordinance in effect on December 5th, 2001.
3. In order to limit office uses with high parking demands, permitted uses of the property, and/or uses
authorized by special use permit, shall include only those uses allowed in Section 23 Commercial
Office of the Albemarle County Zoning Ordinance in effect on December 5th, 2001, a copy of the
section(s) being attached hereto, except the following:
a. Dentist offices (a portion of 23.2.1.2);
b. Churches; and
c. Businesses whose sole purpose or primary activity is providing:
i) Data entry and/or storage, subscription and/or credit card transaction processing; or,
ii) Solicitation of sales and/or order processing by telephone, mail order, internee. catalog
sales or other similar medium; or,
iii) Mailing list preparation.

Dear Mr.Wailer:
I am writing to request a waiver of the loading space requirement,section 4.12.7,for the Rio Square final
site plan for the following reasons:
1) By design,we did not show any loading spaces on the preliminary site plan and
rezoning application. This was a conscious design and something we thought staff,
the Planning Commission,and the Board of Supervisors reviewed. It is therefore a
key feature of our proffered plan and cannot be accommodated without wholesale
changes to the layout and will most likely result in the loss of one or two residential
unit(s).
2) The design of the office buildings and the cooperative parking proffers has been
specifically geared towards small professional clients with limited parking demands.
This includes only occasional UPS/Fed Ex vehicle and no routine large truck
deliveries.
3) Furthermore,through our cooperative parking agreement we feel that there will be a
sufficient number of free spaces during business hours if a delivery truck would need
to park.
