Ridge Court Standardsville, VA 22973 RE: SP 2006 -022 Northridge Community Church of the Nazarene; Northridge Preschool (Sign #79) - Tax Map 21, Parcel 11A Dear Mr. Tucker: On October 4, 2006, the Albemarle County Board of Supervisors took action on SP 2006 -022, Northridge Community Church of the Nazarene — Northridge Preschool, to allow establishment of a Day Care /Pre - school within an existing church, with no exterior building changes proposed, and SP amendment., on Tax Map 21, Parcel 11A in the White Hall Magisterial District. This special use permit was approved based on the following conditions: 1Q Special Use Permit 2006 -22 shall be developed in general accord with the interior concept plan received May 30, 2006, and titled "Northridge Preschool' (Attachment A), Hours of operation shall be limited to 7:30 am to 1:30 pm Monday through Friday; Enrollment shall not exceed eighty (80) children; i;XTLicensure ' he church building must be approved for day care use by the Building Official; by the Virginia Department of Social Services is required; Health Department approval is required before the commencement of the use; and The existing woodland shall remain undisturbed with one exception: the woodland may be disturbed within ten (10) feet of the highest water level in the storm water facility.. In no case shall the site be disturbed within thirty -five (35) feet of the western boundary of this parcel. (Reference Attachment E). Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property as approved above may lawfully begin until all applicable approvals have been received and conditions have been met. This includes: Tucker SP- 2006 -022 Northridge Preschool Page 2 of 2 November 1, 2006 • compliance with conditions of the SPECIAL USE PERMIT; and • approval of a ZONING COMPLIANCE CLEARANCE. In the event that the use, structure or activity for which this special use permit is issued is not commenced within twenty -four (24) months from the date of Board approval, it shall be deemed abandoned and the permit terminated. The term "commenced" means "construction of any structure necessary to the use of the permit." I do hope this is adequate. We were unaware of outstanding paperwork to be submitted. During this past summer, we contacted your office on several occasions to resolve this matter. We also brought copies of the original paperwork to your office because we hadn't received a letter of confirmation. We were told that the Board of Supervisors had cleared the preschool as well as the Health Department and were only waiting on the water testing report. The water testing (performed by Aqua Air) report was normal and a copy was supposed to be mailed to both yourself and Eric Myers at the Health Department. Please let us know if there is any additional paperwork that we need to take care of. We appreciate your prompt attention in the resolution of this matter. According to the documentation provided to us by the Building Official for the County of Albemarle, your total occupancy is 200 people (including teachers). It is our understanding that you will be providing services for 80 children three years through five years of age. Pursuant to the information you have filed with us, your operation is in compliance with the staff -child ratios required in the law. The exemption law requires that you maintain these staff -child ratios throughout the year. Any significant changes in the number of staff or children should be documented on a new Staff /Child Ratio Sheet (along with the supporting health statement for any new employees) and be submitted to this office in order that we may update our records for your facility. Please be sure to get both the Criminal History Record Check and Central Registry Search on all new employees. The exemption law requires that you file the required documentation annually. You will be notified approximately 60 days before the expiration date in order to facilitate the timely filing of the renewal documentation.
