This agreement will allow the residents, businesses and /or guests of the Barksdale Building to park in 15 parking spaces on the west end of the parking lot of Mountainside Senior Living operated by the Jefferson Area Board for Aging (JABA). Mountainside Senior Living was previously known as Windham and is on Tax Map 56A1- 01 -00- 06300. This approval is subject to the following condition: Should the cooperative parking agreement be revoked, abandoned or in any way made unavailable, other arrangements must be completed within 30 days of the end of the agreement to provide the number of deficit spaces at that time based on the use of the Barksdale Building. The parking analysis that was submitted with this request indicates that 18 parking spaces are required for the Barksdale building as shown: for retail on the ground floor - 1470sf x 80% =100 = 12 for office on the upper floor — 1320 x 80% _ 200 = 6 Total parking for the proposed Barksdale Building = 18 spaces. This administrative approval is authorized by the parking ordinance Section 4.12.10 as amended on February 5, 2003. The approval is based on the availability of excess parking spaces at the Mountainside site. It is consistent with the Planning Commission's approvals (under the previous parking regulations) that granted off -site parking for several restaurants in the area as noted below: Barksdale /Morningside Cooperative Parking June 18, 2004 Page 2 Excess parking available on 56A1 -1 -63 (Mountainside) 44 spaces Spaces authorized by the Commission: Ombra's on TMP56A2 -1 -23A (requested by Tim Fisher) 8 spaces Jarman's Gap on TMP56A2 -1 -27 3 spaces Kokopelli's /Mt. Furthermore, we respect your judgement and that of JABA and the other businesses that may be effected by the parking arrangements on the Mountainside parcel. Zoning compliance clearances will be required before any uses in the building may be initiated. The approval of any clearances will be subject to this cooperative parking agreement. Please be aware that changes in uses in the Barksdale building may require additional parking and may trigger the need to amend this agreement.
