Dear Mr. Rice:
This is to advise you that the Albemarle County Board of Supervisors at its
meeting September 17, 1980, approved your request for a public garage on Tax
Map 80, Parcel 59C, Rivanna District, subject to the following conditions:
- -1. Virginia Department of Highways and Transportation review and approval
of entrance;
-2. No outside storage of parts including junk parts;
..3. Removal of vending machines, bus, and other abandoned rn?aterials within
60 days of Board approval of this petition;

On September 21, 2000, Ms. Peggy Gibson applied to the Albemarle County Health Department for a
sewage disposal system repair permit to correct a malfunctioning septic tank system at the above
referenced property. The site was evaluated by department personnel on September 27, 2000 and October
26, 2000.
The Health Department is unable to issue a "conventional" drainfield repair permit to correct this
problem, due to the shallow depths to rock encountered at this site. The present use of this site is for a
auto mechanic shop with a restroom for three employees with a very limited amount of wastewater
generated (approximately less than 50 gallons per day). As part of a solution to the problem, the
department has proposed to Ms. Gibson the use of an incinerating toilet (which is allowable under the
present State Regulations) in the hopes of further reducing the wastewater flow to the point where the
existing septic system will function for the hand sink in the restro_ om. Ms. Gibson has indicated an interest
in this corrective action.
The Health Department is aware that Albemarle County has some general prohibitions against alternative
sewage disposal practices. This is to request your review of this matter to determine if the incinerating
toilet is acceptable as a repair to the existing failing sewage drainfi.eld.
For your information, I have attached copies of the Virginia Department of Health Policy Statement on the
use of incinerating toilets and Incinolet Incinerator Toilets information brochure.

SUBJECT: Approval of Incinolet Electric Toilets
Onsite - Product Approval - Electric Toilet
Section 4.33.A.2.c of the Sewage Handling and Disposal
Regulations states that all incinerator toilets must be certified
by the National Sanitation Foundation as meeting NSF Standard 41
(Wastewater Recycle /Reuse -and Water Conservation Devices).
However, in 1987 NSF determined that Standard 41 does not apply
to electric incineration toilets. Since then, NSF has been in
the process of establishing a new testing protocol for the _
Incinolet electric toilet. NSF has not established a protocol at
this time.
In December, 1993, Incinolet requested a variance to Section
4.33.A.2.c of the regulations on the basis that NSF has not
established a testing protocol for their product, and therefore
cannot provide NSF certification. Further, Incinolet reported
that the product has been approved by UL, Canadian Standards
Association, US Coast Guard, NEMKO (Norway), TUV (Germany), and
JL (Japan).
The commissioner has granted the variance request, and the
Incinolet electric toilets Models CF, RV, TR, and WE have been
approved for use without NSF certification when they are
installed and used following the manufacturer's recommendations.
Enclosed is a copy of their product literature.

use. Please report any field problems that you may have with the
