STOP WORK ORDER
Dear Mr. Wood:
Under § 17 -214 of the Albemarle County Code, you are hereby notified to immediately cease all land disturbing
activities on the above referenced property (STOP WORK) with the exception of work to address the installation of
erosion control measures, soil stabilization, and any necessary drainage corrections as approved by the County. A
sworn complaint has been made by the Inspector, Jonney Otto, who indicates that a prior Notice to Comply had been
issued and the corrective measures have not been met by the agreed upon correction date of January 7, 2014. This
STOP WORK ORDER shall remain in place for seven (7) dys from the date of receipt. If satisfactory repairs have
not been made within seven (7) days, the County may elect to issue another Stop Work Order, and /or petition the
Circuit Court for penalties and relief with regard to this violation.
Required Correction(s):
1. Submit an Erosion & Sediment Plan of Action in accordance with the Virginia Erosion and Sediment Control
Handbook Third edition dated 1992 for county approval, as stated in the Notice to Comply dated January 2,

NOTICE TO COMPLY
Dear Mr. Woods,
Under Section 17 -213, of the Albemarle County Code, this is your NOTICE TO COMPLY with the requirements of
the Erosion Control Permit for the referenced property and to immediately take corrective measures that address the
erosion and sediment control deficiencies on this property. The specific deficiencies and measures required to
correct those deficiencies are as follows:
Deficiency: Minimum Standards 19- Sediment observed in the stream due to the collapse of
the retaining wall. Properties and waterways downstream fi•om development site are not being
protected from sediment deposits and damage.
Required Corrections: Submit an. Erosion & Sediment Plan of Action in accordance with
the Virginia Erosion and Sediment Control Handbook Third edition dated 1992 for county
approval.
Unless subsequently amended in writing by this office, it is expected all of these corrective measures will be
completed by no later than January 7, 2014.

"Permanent vegetation shall be installed on all denuded areas within nine (9) months after the date the land
disturbing activity commenced, except for areas that the program authorty) finds are necessary parts'of the
construction that are subject to an active building permit and areas where erosion is prevented by a non - erosive
sui;face. For the purposes of this section, a "non- erosive surface" includes, but is not limited to, roadways and
sidewalks covered by gravel, asphalt pavement, or concrete; trails or paths covered by gravel., stone dust, or mulch;
buildings and other permanent structures; and such other surfaces that the program authority determines would
adequately provide a permanent barrier to erosion.'.'
Under Sections 17 -213, 214 and 215 of the Albemarle County Code, failure to make these corrections by the
required date can have the following results:
Your permit may be revoked.
You may be required to submit a new Erosion and Sediment Control Plan and have it approved before
additional land disturbance will be allowed. Review of a new plan can take up to 45 days for each submission
and it is not unusual for several submissions before the plan can be approved. This requirement would include
a new application, fee and bond for the work proposed under the plan.
The County may issue a STOP WORK ORDER and seek relief in the Circuit Court. The Circuit Court can fine
the property owner up to $2,000 per violation, convict the property owner of a Class I misdemeanor and require
the property owner to pay any damages resulting fi•om a failure to comply with this notice. Should you have a
legitimate reason you can not complete the corrective measures by the above given date, you must immediately
contact me at (434) 296 -5832. Unless you have contacted us and alternative arrangements have been agreed to
in writing, we will expect the corrections to be completed by the above date.
