RE: SDP - 201300066 North Town Center Sonic Drive -thru — Initial Site Development Plan
Dear Mr. Collins:
The Agent for the Board of Supervisors hereby grants administrative approval to the above referenced site
plan.
This approval shall be valid for a period of five (5) years from the date of this letter, provided that the
developer submits a final site plan for all or a portion of the site within one (1) year after the date of this
letter as provided in section 32.4.3.1 of Chapter 18 of the Code of the County of Albemarle, and thereafter
diligently pursues approval of the final site plan.
An Erosion and Sediment Control Permit may be issued after the following approvals are received:
1. Approval an Erosion and Sediment Control Plan meeting the requirements of Chapter 17 of the
Code of the County of Albemarle.
2. Approval of all easements for facilities for stormwater management and drainage control.
The final site plan will not be considered to have been officially submitted until the following items are
received:
1. A final site plan that satisfies all of the requirements of section 32.6 of Chapter 18 of the Code.
2. A fee of $1,500.
3. Submittal of plans directly to each of the agencies /departments listed below necessary to satisfy
the conditions of approval.
The final site plan will not be approved until the following conditions are met:
The Department of Community Development shall not accept submittal of the final site plan for signature
until tentative approvals for the following conditions have been obtained:
Planning Division Approval of (2 Copies are required to be submitted for review)
1. A site plan meeting all the requirements of section 32.6 of Chapter 18 of the Code.
2. [32.5.2(a)]
• The 10' parking setback line on Sheet 2 Layout and Sheet 4 Landscape Plan is mislabeled as
the building setback line. Correct the label on both sheets.
• Revise the sheet number section of each title block to indicate the total number of sheets e.g.

Sheet 1 of 6
• Revise the "Proposed Boundary" label on Sheet 3 Layout to say "Proposed Project Limits ".
• Revise Sheet 2 Existing Conditions to show the boundary lines for TMP 45 -111B.
3. [32.5.2(b)]
• Update the parking schedule on Sheet 1 Cover to reflect the parking spaces and loading
spaces lost and the parking spaces gained with this proposal. Revise Sheet 3 Layout to clearly
show all previously approved parking and loading spaces along the Gander Drive frontage.
Indicate which spaces are to remain and which are to be removed.
• Revise the parking schedule to indicate the total number of required parking spaces for the
StellarOne Bank and Sonic Drive -thru in Phase 1 and the total number of spaces provided in
Phase 1 with this proposal.
4. [4.12.13(d)] [4.12.18(a)] Revise this proposal to show the previously approved loading space (12'
wide x 25' long) adjacent to Gander Drive and the southeast corner of the project area. Show a
paved pedestrian access from the loading space to the Sonic parking lot/bypass lane.
5. [4.12.19] Revise Sheet 3 Layout to show a concrete dumpster pad. Show the pad extending a
minimum of 8 feet beyond the front of the enclosure for the truck's front wheels to rest on.
6. [32.5.2(d)]
• Label existing contours on Sheet 3 Layout and Sheet 4 Landscape Plan.
• Increase the font size of the critical slope waiver approval on Sheet 1 Cover, so as to be
readable.
7. [32.5.2(i)] Label Gander Drive on all site plan drawings.
8. [32.5.20)]
• Revise Sheet 2 Layout and Sheet 4 Landscape Plan to show the limits of the easement
associated with the sanitary sewer lateral serving the bank property to the north; indicate the
deed book and page number for the easement.
• Revise both sheets to indicate the size of all existing water and sewer lines.
9. [32.5.2(l)] Revise Sheet 2 Layout and Sheet 4 Landscape Plan to show the location of proposed
utilities and their easements not shown, including telephone, electric, cable and gas.
10. [32.5.2(1) ] Revise Sheet 2 Layout to indicate the distance to the centerline of the nearest existing
street intersection from the proposed ingress and egress locations.
11. [32.5.2(n)]
• Provide the proposed paving materials for walks, parking lots and other paved areas.
• Provide a lighting photometric plan with fixture information. No lighting locations are
approved until this information is provided.
12. [32.7.9.4(a)]
• Revise the plant schedule on Sheet 4 Landscape Plan to include plantings "IV" and "IS"
shown on the landscape plan.
• Revise Sheet 4 Landscape Plan to include further clarification on what is meant by the label
"Brick w/Landscaping Planters (typ)" ; e.g. are the planters movable pots or structural with
walls. Structural planters locations would need to be shown on the drawing.
13. [32.7.9.6(a)]
• Revise Sheet 4 Landscape Plan to indicate how the required 5% interior landscape planting is
provided.
• Provide proof that the trees, shrubs and dumpster are permitted in the existing sanitary sewer
easement along the southern perimeter of the project area. Provide a deed book and page
reference for that easement.
• Provide proof that proposed plantings are permitted in the sewer lateral easement for the
bank.
14. [32.7.9.8(a)] Revise the tree canopy schedule on Sheet 4 Landscape Plan to include a breakdown
of how the required canopy is being provided.
15. [4.12.6, Drive -in lane serving any use] The stacking in the drive -thru lane is impeding pedestrian
use of the ramp crossing the drive -thru lane. Revise the site layout to remedy this issue.
16. [4.12.16 ] The 8 westernmost angled parking spaces, across from the entrance to the drive -thru
lane, do not have the required 16 foot travelway width. Revise the site layout to remedy this issue.

17. [4.12.17(c)(2)] Widen the drive -thru lane to the minimum 12 foot width required.
18. [4.12.17(c)(2)(a)] Widen the bypass lane, along the south side of the building, to the minimum 16
foot width required.
19. [Comment] The Special Use Permit for the drive -thru window must be approved prior to Final
Site Plan approval.
20. [Comment] Architectural Review Board approval is required prior to Final Site Plan approval.
Engineering Division Approval of. Copy s required to be submitted for review)
1. An Erosion and Sediment Control Plan meeting the requirements of Chapter 17 of the Code of the
County of Albemarle.
2. All easements for facilities for stormwater management and drainage control.
3. Topography will need to be updated/field verified within a year of the submittal date. Plan
currently shows a topographical certification date of September 2012.
4. Travel ways do not appear to meet the minimum widths per 18- 4.12.16, 18- 4.12.17 and ACDSM
7.C.2. 60 degree parking requires a minimum 20' isle with a minimum stall depth of 20.1 feet for
the entire length of parking area also, 18' depth appears to be shown incorrectly.
5. Bumper Blocks are recommended to ensure cars are not hanging out int the travel lane.
6. Drive -thru lane radii appears too small for AASHTO single unit truck. 18- 4.12.17.d
7. WPO aplication fee and plans will be required for final approval. Please submit 2 sets of WPO
plans for review.
Albemarle County Architectural Review Board Approval of a Certificate of Appropriateness. (8 Conies
are required to be submitted for review)
1. Regarding requirements to satisfy the design guidelines as per § 18- 30.6.4(2), (3) and (5):
• As per § 32.4.2.2(b)(3) and 30.6.4(c)(3) and EC Guidelines 35a and 36b, it is not clear that
sufficient planting area is available along the north side of the parking lot to accommodate
trees at 2 %z" caliper, 40' on center; or along the south side of the parking lot (drive -thru
travelway) to accommodate shrubs and trees at 2 %Z" caliper, 40' on center; or that sufficient
planting area is available to accommodate shrubs along the western edge of the drive -thru to
mitigate the appearance of the drive -thru use and its associated site features.
2. Regarding recommendations on the plan as it relates to the guidelines:
• See comments on the preliminary proposal.
3. Regarding recommended conditions of initial site plan approval:
• A Certificate of Appropriateness is required prior to final site plan approval.
• Clarify how the trees along the north edge of the parking lot will be allowed to reach their
natural form, without excessive pruning, when planted so close to the canopy.
• Provide proof that all the proposed tree and shrub plantings along the southern boundary of
the parking lot and shrubs along the western edge of the travelway are permitted in the
sanitary sewer easements at both locations.
4. Regarding conditions to be satisfied prior to issuance of a grading permit:
1. None
5. The ARB offered the following comments on the initial plan for the benefit of the applicant's
next ARB submittal:
a. Provide building material and color samples for review.
b. Remove the poster display boards from the proposal.
c. Provide an interior building floor plan.
d. Provide a site/building elevation, as viewed from the EC, showing the entire width of the site
including the canopies and building.
e. Provide specs on the proposed glass. Ensure that the VLT shall not drop below 40% and the
VLR shall not exceed 30 %.
f. Provide a dumpster enclosure detail on the site plan drawings. A brick wall enclosure, of the
same red brick in the building, would provide a coordinated appearance.

g. Revise the proposal by relocating all the rooftop units to the EC end of the roof and revising
their design so the top of the unit is below the top of the cornice. Provide a section to confirm.
h. Revise the site plan drawings by labeling all site features shown. On Sheet 5 Site Cross -
Sections, verify which of the cross sections labeled "CROSS SECTION 2" is actually Section
3 and revise the drawing accordingly.
i. Reduce the negative visual impact of the drive -thru and its associated features, as viewed
from the EC, by revising the planting plan to reduce visibility of this area and redesign the
rear and side elevations to relieve the back door appearance.
j. Revise the Plant Schedule on Sheet 4 Landscape Plan to show all shrub planting heights at
24" minimum. Include shrub plantings "IV" & "IS" in the schedule.
k. Revise the drawing to show the limits of the sanitary sewer easement beneath the Inkberry
Holly shrubs. Replace the Inkberry Holly shrubs with a mix of three evergreen shrub species,
planted in an informal, staggered arrangement and provide proof that they would be allowed
in that easement. Show their planting heights at 36" minimum.
1. Revise Sheet 4 Landscaping Plan by reducing the spacing of the 1 Allee Elm & 2 London
Plane trees, shown along the northern edge of the site, to 40' maximum. Add another large
tree.
m. Include a dashed outline on the landscape plan showing the limits of the canopies. Clarify
how the trees will be allowed to reach their natural form, without excessive pruning, when
planted so close to the canopy.
n. Add another large tree in the planting island immediately east of the dumpster enclosure
(south end of the site) and provide proof that all the proposed plantings along the southern
boundary are permitted in the sanitary sewer easement. If trees aren't permitted, increase the
planting area.
o. Provide a complete lighting plan for review. All wall and site lights shall be full cutoff
fixtures. Canopy lights shall be flush -mount or recessed. Wall lights shall be down lights only
and located so as to illuminate the sidewalk without over - illuminating the building.
p. Include the standard lighting note on the lighting plan.
q. Provide a lighting plan that limits canopy illumination values to 20 footcandles.
r. Separate applications for signs are required. The sign type is appropriate; however, overly
intense sign colors will not be approved and illumination will be limited to internal
illumination of the channel letter text with no illumination of the backer panel.
s. Remove the poster display boards from the proposal.
t. The stall menu boards facing the EC should not be internally illuminated.
u. Provide a 3D visualization illustrating the view from the corridor, with existing and proposed
vegetation.
v. Provide additional information on the stall menu boards to clarify the "advertisement" side.
Albemarle County Fire & Rescue Approval (1 Copy is required to be submitted for review)
1. Notify the Fire Marshal's Office the type of construction to be used, so the fire flow can be
determined.
2. Hydrant locations, show that you have a hydrant within 500 ft per travelway.
3. Submit the fire flow test results.
Albemarle County Service AuthorityApproval (3 Copies are required to be submitted for review)
1. Dedication of Northtown Phase 2A required prior to the ACSA granting approval on the Final
Site Plan.
2. Proposed trash dumpster enclosure and pad are not permitted within the existing ACSA sewer
easement. Relocate the proposed structure.
3. Provide fixture counts when available so the ACSA can size the water meter and quote
connection fees.
4. Show the easement for the sanitary sewer lateral for Stellar One Bank.
5. Show sewer connection to building.
6. Show a grease interceptor and how it will be piped with the lateral.

7. Call out a backflow preventer on the domestic water service.
8. Add note that ACSA inspector will inspect any work associated with the water meter.
Virginia partment of Transportation Approval. (1 Copy is required to be submitted for review)
1. The engineer should verify that the proposed usage is consistent with the usage identified in the
approved TIA for the development.
