Box 9011 Charlottesville, VA 22906-8011 RE: OFFICIAL DETERMINATION OF PARCELS --Tax Map Parcel — 032AO-01-OA- 00800 (Property of Michael W. Worley) - Rio Magisterial District Dear Mr. Bates: The County Attorney and I have reviewed the title information for the above -noted property. It is the County Attorney's advisory opinion and my official determination that Tax Map Parcel 032AO-01-OA-00800 is two R-1 zoned parcels of record. The basis for this determination follows. Our records indicate Tax Map 32A -01=0A, Parcel 8 contains 4.65 acres and one (1) dwelling. The property is not within an Agricultural and Forestal District. The most recent recorded instrument for this property is recorded in Deed Book 4307, page 30. This analysis begins with the deed of record in Deed Book 350, page 193 that is dated June 15, 1959. This deed contains the subdivision plat of "Clover's Airport Acres", which shows separate lots 8 & 9 in Block A. This plat was made by William S. Roudabush and Associates, Certified Land Surveyors. This deed establishes Tax Map Parcel 0032A -01 -OA -00800 as two parcels of record (Lots 8 & 9 on referenced plat), zoned R-1 residential. Each of the two lots contain more than one acre of land. Deed Book 359, page 230, dated June 1, 1960, conveyed "all those two certain lots or parcels of land... designated as Lot Nos. 8 and 9, Block A" as shown on the plat in Deed Book 350, page 193 from Burtt B. Clover and wife to William J. Pace and Josephine R. Pace, husband and wife. The land is described as the same as shown on the plat referenced in Deed Book 350, page 193. This transaction had no effect on the parcels. Deed Book 382, page 117, dated September 4, 1962, conveyed Lots 8 and 9, Block A ... of Clover's Airport Acres from William J. Pace and Josephine R. Pace, husband and wife to Ralph E Hill and Jeannette M. Hill, husband and wife. The property is described as being the same as was conveyed by Deed Book 359, page 230. This transaction had no effect on the parcels. Mr. Grant M. Bates January 31, 2014 Page 2 Deed Book 628, page 191, dated August 8, 1977, conveyed Lots 8 and 9, Block A of Clover's Airport Acres from Ralph E Hill and Jeannette M. Hill, husband and wife to Henry J. Barral. The property is described as being the same as was conveyed by Deed Book 382, page 117. This transaction had no effect on the parcels. Deed Book 953, page 036, dated June 12, 1987, conveyed Lots 8 and 9, Block A of Clover's Airport Acres from Henry J. Barral and Catherine Barral, husband and wife, to Michael W. Worley and Lillian M. Worley, husband and wife. The property is described as being the same as was conveyed by Deed Book 628, page 191. This transaction had no effect on the parcels. Deed Book 4307, page 30, dated May 7, 2013, conveyed Lots 8 and 9, Block A of Clover's Airport Acres from Lillian M. Worley and Michael W. Worley, her husband, to Michael W. Worley. The property is described as being the same as was conveyed by Deed Book 953, page 036. This transaction had no effect on the parcels. The single family residence on this property (3525 Airport Acres Road) is on Lot 8, leaving Lot 9 vacant with the access to Lot 8 crossing it. Lot 9 contains at least one acre of land, which meets the minimum lot size required in the R-1 zoning district for construction of a single family detached dwelling . If you are aggrieved by this determination, you have a right to appeal it within thirty days of the date notice of this determination is given, in accordance with Section 15.2-2311 of the Code of Virginia. If you do not file a timely appeal, this determination shall be final and unappealable. An appeal shall be taken only by filing with the Zoning Administrator and the Board of Zoning Appeals a notice of appeal which specifies the grounds for the appeal. An appeal application must be completed and filed along with the fee of $240. The date notice of this determination was given is the same as the date of this letter.
