Princess Drive, Suite 190 Scottsdale, AR 85255 RE: LZC201300011, Woodlands Daycare, 601 Hillsdale Drive, Charlottesville, VA 22901 Tax Map Parcel 061ZO- 03- 00 -OIOAO (the "Project " / "Property ") Dear Ms. Ferris: In response to your request for information regarding the above referenced Project and Property, we have researched our records and are pleased to advise you that: 1. The property is zoned Planned Unit Development (PUD) under the applicable zoning laws and ordinances of the County of Albemarle, Virginia. The private school use existing on the Property is a use permitted by -right in the commercial portion of the PUD zoning district and legally conforming. 2. The original site plan (SDP 1992 -014) was approved March 12, 1992. The site was inspected on July 11, 2013. No zoning or site plan violations were found. To the best of my knowledge, the current use of the Property complies with all applicable zoning laws and ordinances of the County of Albemarle, Virginia, including the required parking of 29 spaces, which are provided on site. 4. To the best of my knowledge, there are no outstanding zoning violations on the Property and there no pending administrative, legislative or judicial proceedings that would adversely affect the status of the Property's current zoning. 5. The Property is recognized as one separate parcel of land under applicable subdivision laws and ordinances and may be conveyed, leased or mortgaged as one or more separate parcels and currently complies with such subdivision laws and ordinances. 6. In the event of casualty to the Project, in whole or in part, the structure may be rebuilt with no loss of square footage. Ms. Lesa Ferris July 26, 2013 Page 2 7. The project was issued a Certificate of Occupancy. Copies of Certificates of Occupancy are maintained on microfilm. Therefore, we have not retained any paper copies of Certificates of Occupancy associated with this Project. Furthermore, the absence of a Certificate of Occupancy for the Project will not give rise to any enforcement action. Please be aware that interior renovation that does not involve a change of use does not require a Certificate of Occupancy. You may obtain a copy of a Certificate of Occupancy for an additional fee of $25.00 each by contacting Esther Grace, Records Manager at (434) 296 -5832. On the basis of this information it is my opinion that the Woodlands Daycare facility on this Property is in compliance with the zoning regulations of Albemarle County.
