Approval letters attached. • Currently the Property is not subject to pending applications for re- zonings, special use permits or variances. • This Property is subject to the Site Development Plan, SDP1995 -00048 that was approved on May 11, 1995 and amended with SDP1995 -00049 on August 16, 1995 and also with SDP2006 -00123 on February 7, 2007. The Property may be developed per the approved plans. • The zoning ordinance requires a zoning clearance in the following circumstances: 0 1. New use. Prior to establishing a new non - residential, other than an agricultural, use. 0 2. Change or intensification of existing use. Prior to changing or intensifying an existing non - residential, other than an agricultural, use. 0 3. Change of occupant. Prior to a new occupant taking possession of an existing non residential, other than an agricultural, use. This means that if the building is being used by doctor "A" as a doctor's office and he leaves and doctor "B" moves in then "B" should obtain a new zoning clearance. The zoning clearance is not required for an entity to purchase the property, only to use the building for a permitted use. Any building additions would require site plan amendment approvals. • This office has no record of any open zoning violations for the Property. Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property as approved above may lawfully begin until all applicable approvals have been received and conditions have been met. This includes: compliance with conditions of the SPECIAL USE PERMIT; • approval of and compliance'with a SITE PLAN and • approval of a ZONING COMPLIANCE CLEARANCE. In the event that the use, structure or activity for which this special use permit is issued is not commenced within twenty -four (24) months from the date of Board approval, •it shall be deemed abandoned and the permit terminated. The term "commenced" means "construction of any structure necessary to the use'of -' the permit."
