Fox, Jr. Foxfyre Enterprises, Inc. 4543 Garth Road Charlottesville, VA 22901 RE: ZMA-1991-08 Proffer #2 & ZMA-2006-18 Proffer #2 Dear Mr. Fox: You have asked for a confirmation of the process by which the. area reserved for the connecting road to Tax Map 32, Parcel 33 would be dedicated pursuant to ZMA 1991- 08 and ZMA-2006-18. ZMA-1991-08 Nellie Mobray was approved with proffers on January 22, 1992. ZMA- 2006-18, approved on January 10, 2007, amended the prior rezoning. However, it retained Proffer #2 without change. Proffer #2 of both actions is provided below. The applicant agrees that any plan submitted to the County after rezoning will include areas reserved for construction of connecting internal roads with 50 foot rights-of-way to adjacent properties, with the exception of Forest Lakes Townhouses, for future access as the County may deem necessary. The applicant shall not be obligated for the cost of construction of such connecting internal roads. The subdivision plat, titled Forest Ridge, dated September 28, 1994, shows Parcels C and D and notes that "Parcels C and D are reserved for future access." This plat is included in the covenants and restrictions of Forest Ridge. A copy of this plat is enclosed. The subdivision plat, dated December 5, 1997, that created Lots 12A and 12B that are adjacent to Parcel D notes, "Parcel D shall serve as an access easement to Lot 12A & Lot 1213, until such time Parcel D is dedicated for public use per subdivision plat of Forest Ridge recorded at D.B. 1444, p. 422 — 423." A copy of this plat is enclosed. The Zoning Administrator shall enforce Proffer #2 by demanding dedication of Parcel D upon receipt of an application to rezone or subdivide Tax Map 32, Parcel 33. An appeal shall be taken only by filing with the Zoning Administrator and the Board of Zoning Appeals a notice of appeal which specifies the grounds for the appeal. An appeal application must be completed and filed along with the fee of $120. The date notice of this determination was given is the same as the date of this letter.
