I have been asked if the plat creating TMP 41-8, 8B, 8C, 8D constituted a violation of the subdivision ordinance. This plat
was prepared and recorded in 1977. 1 have researched the ordinance in effect at that time and find no violation of the
ordinance exists. No plat had to be submitted for review as the division was not considered a subdivision by the definition
of the ordinance. The definition read, in part:
"The term 'subdivision' shall include: The division of a parcel of land into two or more lots, parcels or tracts such that: (a)
Any one of such lots, parcels or tracts is less than five acres in areas; or (b) Any one of such lots, parcels or tracts does
not front on a road which is part of the State Highway System or State Secondary Highway System;"
