Keller -Fox or Melba C. Christy) Section 10.3.1 Dear Ms. Jay: The County Attorney and I have reviewed the title information for the above -noted property. It is the County Attorney's advisory opinion and my official determination that TMP 059C2 -01-00-033A0 has two (2) theoretical development rights. In order to utilize these development rights a plat that is approved by the County that correctly states the development rights must be recorded. The basis for this determination follows. Our records indicate that this parcel contains 4.151 acres and one dwelling. The property is not in an Agricultural and Forestal District. The most recent recorded instrument for this property is recorded in Deed Book 2604, page 151. This analysis begins with the plat recorded in Deed Book 355, page 281. The plat by A. R. Sweet & Associates, dated July 1959, shows an area of West Leigh designated as Section 1 that includes Lot 33 and an adjacent well lot. Lot 33 contains 8.608 acres. The well lot is not included in the 8.608 -acre lot. The acreage of the well lot is not provided on the plat. Deed Book 446, page 499, dated July 31, 1968, conveyed several well lots from Sydnor Hydrodynamics, Inc. to The Board of Supervisors of Albemarle County. Among these properties was the water system of West Leigh Subdivision. The lot is described by reference to Deed Book 392, page 409. The acreage of the parcel is not specified in this deed. Nor is the acreage specified in the aforementioned deed. Deed Book 599, page 596, dated July 7, 1976, conveyed two well lots from the County of Albemarle to Charles Wm. Hurt. One of these was the West Leigh lot that is described as Tax Map 59C-2-01 Parcel 33A and by reference to Deed Book 446, page 499. Again, the acreage of the well lot is not specified in this deed. I:\DEPTOCMDetermin of Parcel\2005\59C2-1-33A Kauffman -Fox & Christy.doc Joan Jay December 15, 2005 Page 2 The most recent instrument for this parcel recorded prior to the adoption of the Zoning Ordinance, December 10, 1980 is recorded in Deed Book 665, page 558 and dated January 31, 1979. This is a deed of exchange between Charles Wm. Hurt and Phil N. Keaton & Bernice A. Keaton. The transaction is shown on a plat by B. Aubrey Huffman & Associates titled, "Revised Lot 33 & Well Lot, Section One West Leigh" dated January 11, 1979. The plat shows Parcel Y, containing 4.775 acres, which is a portion of Lot 33 that is combined with a portion of the well lot. The acreage of the portion of the well lot that was combined with Parcel Y was not specified on this plat. On the basis of this deed and plat it is determined that Parcel Y, containing 4.775 acres plus the portion of the well lot that was combined with parcel Y is a lot of record with two (2) development rights. Deed Book 799, page 433, dated May 18, 1984, conveyed numerous parcels situate in Albemarle County from Charles Wm. Hurt to Charles Wm. Hurt and Shirley L. Fisher, Trustees for the Virginia Land Trust. Among these parcels was a certain lot described as Parcel Y, containing 4.775 acres and the well lot conveyed by the deed of record in Deed Book 665, page 560. This transaction had no effect on the development rights of Parcel 33A. On March 3, 1989 the County approved a plat by B. Aubrey Huffman & Associates, dated February 10, 1989, showing a portion of Parcel 33A to be added to Lot 1, Section 3, West Leigh. The residue of Parcel 33A is shown to contain 3.620 acres after the conveyance of Parcel X, containing 1.155 acres to Lot 1. The plat notes that Parcel 1 and Parcel 33A may not be further divided into parcels of less than 21 acres. The acreage on this plat was incorrect because the 1.155 acres was subtracted from 4.775 acres rather than the total acreage of the lot that also included the area of the well lot. This approved plat was not recorded. Deed Book 1043, page 224, dated April 12, 1989, conveyed a lot from Charles Wm. Hurt to Charles Wm. Hurt and Shirley L. Fisher, Trustees to Millie O. Robertson and Charles Wm. Hurt, individually. The property is shown on the plat by B. Aubrey Huffman & Associates, dated February 10, 1989 and approved by the County on March 3, 1989, showing a portion of Parcel 33A to be added to Lot 1, Section 3, West Leigh. However, on the recorded plat the total acreage is shown to be 5.306 acres, resulting in a residue of 4.151 acres after the conveyance of Parcel X, containing 1.155 acres to Lot 1. The revised plat also carried the note that Parcel 1 and Parcel 33A may not be further divided into parcels of less than 21 acres. Based on a search of our records, it appears that the recorded plat showing the corrected acreage was not submitted to the County for approval. As a result, the development right note was not corrected to indicate the lot actually had two development rights because the lot contained more than 4 acres. The recordation of an unapproved plat is a violation of the Subdivision Ordinance. Therefore, in order to utilize the development rights associated with this lot a corrected plat must be approved by the Countv and recorded. Deed Book 1999, page 155, dated March 7, 2001, conveyed a 4.151 -acre lot from Charles Wm. Hurt and Shirley L. Fisher, Trustees for the Virginia Land Trust to Erik B. The deed notes that the lot is identified as TM 59C (2) 01-33A and is described on a plat by B. Aubrey Huffman & Associates, dated February 19, 2001, that is attached to the deed. However, the referenced plat is not recorded with this deed. The deed further notes that the parcel is a portion of the property conveyed by the deed of record in Deed Book 799, page 433. This transaction had no effect on the development rights of Parcel 33A. Deed Book 2194, page 548, dated May 7, 2002, conveyed a 4.151 -acre lot from Erik B. Carlson and Melissa A. Smith to Erik B. Carlson and Melissa A. Carlson. The property is described as being the same that was conveyed by the deed of record in Deed Book 1999, page 155. This transaction had no effect on the development rights of Parcel 33A. Deed Book 2604, page 151, dated September 24, 2003, conveyed a 4.151 -acre lot from Erik B. Carlson and Melissa A. Carlson to Keller Kaufman -Fox and Melba C. Christy. The property is described as being the same that was conveyed by the deed of record in Deed Book 2104, page 547. This transaction had no effect on the development rights of Parcel 33A. The parcel is entitled to the noted development rights if all other applicable regulations can be met. These development rights may only be utilized within the bounds of the original parcel with which they are associated. These development rights are theoretical in nature but do represent the maximum number of lots containing less than twenty one acres allowed to be created by right. If you are aggrieved by this determination, you have a right to appeal it within thirty days of the date notice of this determination is given, in accordance with Section 15.2-2311 of the Code of Virginia. If you do not file a timely appeal, this determination. shall be final 'and unappealable. An appeal shall be taken only by filing with the Zoning Administrator and the Board of Zoning Appeals a notice of appeal which specifies the grounds for the appeal. An appeal application must be completed and filed along with the fee of $120. The date notice of this determination was given is the same as the date of this letter.
