Re: Division rights determination for Greenway Farm (Tax Map 69, Parcels 49 and 54)
Dear Mr. Shepherd:
This is to request a Division Rights Determination for the referenced parcels, both of which
are zoned Rural Areas. Enclosed please find the request form, together with a check for the $40.00
processing fee and copies of the referenced documents. Following is my calculation of the property's
development rights, which I would like you to verify.
TMP 69-49; 54.5 acres. This property supports the Greenway Farm House, a cottage and
various barns, sheds and other farm dependencies, and is in land use. Prior to December 10, 1980,
tb- property was a single, 54.5 -acre parcel owned by Oscar Douglas Royals and Anne Boswell
Royals by deed dated April 20, 1973 and recorded in Deed Book 535, page 315. The parcel is not
shown on any plat of record; however, the legal description is contained in the deed to the Royals, a
copy of which is attached. The parcel remains under the ownership of the Royals, and has not been
subdivided. Based on this history, it appears that TMP 69-49 retains its original five development
rights.
TMP 69-54; 44 acres. This property is unimproved and is in land use. Prior to December
10, 1980, the property was a single, 44 -acre parcel owned by O. Douglas Royals and Anne B. Royals
by deed dated April 20, 1973 and recorded in Deed Book 547, page 287. The parcel is not shown on
any plat of record; however, the legal description is contained in the deed to the Royals, a copy of
which is attached. The parcel remains under the ownership of the Royals, and has not been
subdivided. Based on this history, it appears that TMP 69-54 retains its original five development
rights.
Conclusion. The parcels in question together contain 10 development rights. These
dE°relopment rights are retained in addition to parcels that may be divided as a matter of right within
