Parcel 8Z has no development rights. Therefore, no parcels containing less than 21 acres can be divided from it. However, parcels containing at least 21 acres could be created from Parcel 8Z. Such a 21 -acre parcel can support one dwelling. Therefore, the clubhouse could be converted into a dwelling provided it is on a parcel containing at least 21 acres. I regret any confusion caused by my not first mentioning the potential to create 21 -acre parcels. I base this finding that T.M. 80-8Z has zero development rights on the conditions of approval of SP -95-12. Condition 1 states, "Development of this subdivision shall be in general accordance with the Keswick Estate Application Plan dated November 28, 1994 and revised April 3, 1995 and May 1, 1995." That plan includes a chart titled "Keswick Estate Development Rights/Lot Comparison." That chart identifies Parcel 8Z as the existing golf course containing 139.049 acres. The cell under development rights is empty. The number of proposed lots is 0. Regarding TM 80-8Z, what is the county's position regarding the number of single family lots that can be legally developed on this one parcel? John Shepard's email (that you FAXED to me) states that TM '80-8Z has "zero development rights". I learned a long time ago that planners sometimes make mistakes. It was determined then that Parcel 8Z has zero development rights. I will deliver a copy of the special permit action letter and the determination memo with the attached list of parcels with their development rights.
