In the course of working on the parcel determination for T.M. 103-43 1 discovered that Janice
Sprinkle determined on August 13, 1992 that the parcel has four development rights. That
determination stands today. Under this over please find a copy of that determination and a
copy of the plat recorded in DB / P 1018 / 139. 1 apologize for the time and expense this delay
has caused. We will refund the $40.00 fee.

RE: DEVELOPMENT RIGHTS ON "PARENT PARCEL" TAXAMAP.103ri,
PvARCEL 4'3;x.
On or about August 3, 1992, John White, Jr. inquired as to
clarification of development rights on Tax Map 103 Parcel 43L, a
44+ acre parcel owned by his parents. This department had signed
a plat October 12, 1988 that subdivided the 44+ acres from the
253+ acre residue of Tax Map 103 Parcel 43 (copy attached). The
notes on that plat are:
a. Tract 1 may be further divided .into one lot of less than 21
acres.
b. The residue of Tax Map 103 Parcel 43 may be further divided
into four lots of less than 21 acres.
Mr. White also had a copy of a letter dated August 13, 1991 from
Gregory M. Johnson, (attorney) to Mr...White, Sr. (copy attached)
that referred to an opinion from Amelia Patterson, ('Zoning
Administrator) and concluded that;"_all of your development rights
went with the property sold to Mr. Kluge." (The 253+ acre
residue of Tax Map 103 Parcel 43was sold to JWK Properties,
Incorporated in September 1988.)
After researching the files in.the Planning, Zoning, and Real
Estate offices; talking to Amelia Patterson, George St. John
(County Attorney) and Bill Fritz (the Senior Planner who reviewed
the 1988 plat) the following decisions regarding development
rights are. being recorded here in memorial (see the attached Tax
Map for the parcel references):

1. Tax Map 103 - Parcel 39A (86.819 acres) contains 5
development rights as stated on the plat signed September
23, 1982 and noted by N. Mason Caperton (copies attached) in
SUB -82-103, John G. and Marion M. White.
2. Tax Map 103 - Parcel 43K (76.12 acres) contains six
development rights as stated on plat signed September 23,
1982 in SUB -82-103, John G. & Marion M. White.
3. Tax Map 103 - Parcel 39 (8.5 acres) contains two development
rights; reference same file/plat as 42.
4. Tax Map 103 - Parcel 43J (25 acres) contains two development
rights; reference same file/plat as #2.
5. Tax Map 103 - Parcel 43H (25 acres) contains five
development rights as noted by N. Mason Caperton in
SUB -82-103, John G. and Marion M. White.
6. Tax Map 103 - Parcel 43L (44.24 acres) contains one
development rights as stated on the plat signed October 12,
1988. SUB -88-182, John B. and Marion M. White.
7. Tax Map 103 - Parcel 43 (253.9 acres) contains four
development rights as stated on the plat signed October 12,
1988. SUB -88-182, John B. and Marion M. White.
Although all portions of this "parent parcel" are not being
treated the same, each portion is being considered under the
policy in force at the time a request for subdivision was made.
