Box 1287 Harrisonburg, VA 22803 RE: Zoning Compliance letter for 3906 Seminole Trail Tax Map 32, Parcel 22C1 (the "Property") Dear Mr. Flora: Fax (434) 972-4126 In response to your firm's request concerning the above referenced parcel's compliance with applicable codes, regulations and ordinances, please be advised as follows: The Property is currently zoned Heavy Industrial (HI) and is located in the Entrance Corridor Overlay District (EC) and Airport Impact Overlay District (AIA). ■ Section 28.2.1 (3) allows concrete mixing plants, storage and distribution, with associated offices, as a permitted by right use in the HI District. No Special Use Permits or Zoning Map Amendments were required for this use to be conducted on the parcel. A site plan, SDP2001-126, was approved for parcels 22C1 and 22C2 to allow an office building, a 32,502 sq.ft. concrete pad, and the accessory structures C:Ainetpub\wwwroot\cityviewlazerfiche_integration\tempdocholder\13919.doc Mr. John W. Flora, Esq. September 20, 2011 Page 2 currently located on the parcel. The site is served by 8 parking spaces. The Planning Commission approved a modification of the setback for the silo on April 20, 2010. A site plan amendment was approved June 3, 2010 to allow the silo placement. ■ A boundary line adjustment plat, SUB2002-278, prepared by Roudabush, Gale and Associates, was approved which combined the two parcels. ■ A Certificate of Occupancy was issued March 15, 2004 for the office building. ■ A Zoning Clearance was approved March 11, 2004 to allow the use as proposed. A Certified Engineer's Report was submitted with that application. New Clearances were approved May 13, 2010 to allow for the operator to change from Ennstone to Wilson Ready Mix. ■ The property currently is in compliance with all of the applicable zoning codes and ordinances. This office has no record of open or pending violations. The property was inspected on September 20, 2011 and no violations or deficiencies were observed. Please contact me if you have questions.
