Dear Ms. Vogele:
You have asked for a letter that provides verification of the zoning and other
information regarding the referenced property. This letter is based on a review of
our records and an inspection of the site.
The property is zoned Planned District- Shopping Center- PD -SC and is in the
Entrance Corridor overlay district (EC) and the Airport Protection overlay district
— (AIA). The property is developed as part of a shopping center which contains a
variety of uses that are permitted by right in the C-1, C -O and HC districts, all of
which are permitted by right in the PD -SC district, including the IHOP restaurant.
Zoning of adjacent properties includes: Planned Development -Shopping Center
(PD -SC); Highway Commercial (HC), and; Commercial (C-1).
The Board of Supervisors approved the rezoning of the property to PD -SC in
1987 subject to modifications and conditions. A copy of the approval letter
associated with ZMA-1987-007 is enclosed.
The property is developed in accord with the application plan approved with the
rezoning and the site development plan first approved on March 24, 1988. The
site plan has been revised several times since. These plans indicate the current
buildings comply with height, setback, lot coverage, parking, and FAR
requirements for the PD -SC district.

The property was inspected for zoning compliance on September 8, 2010. One
site plan violation was identified. There are a number of shrubs and some trees
missing along the frontage of Route 29 North which were part of the original site
plans and will need to be replaced. No other violations were identified.
We have no record of any other unresolved zoning violations or pending notices
of zoning violations for the property apart from the issue of the landscaping.
We have no record of any unresolved building code violations or pending notices
of building code violations for the property.

Agreements Made by the County and the Applicant:
1. Agreement to develop property in general compliance
with modified Application Plan. Variations may be
permitted as provided in Section 8.5.6.3 of the Zoning
Ordinance;
Staff approval of subdivision plat to include
dedication of right-of-way on Rte. 29N as recommended
by Virginia Department of Transportation; property line
adjustment or easement to insure access for property to
north opposite first access off of Woodbrook connector.
Notes on plat restricting access to Rte. 29N. Plat shall
also carry notation as to dedication of right-of-way for new
roads upon demand of County. Right-of-way for Woodbrook
Connector, Berkmar Extended and Colonial Pontiac shall be
determined by the Virginia Department of Transportation.
3. Agreement to construct Berkmar Drive Extended and
Woodbrook connector to ultimate Virginia Department of
Transportation standards. Agreement to construct
Colonial Pontiac roadway to private road standards.
4. Agreement to rezone four commercial lot remnants on
west side of Berkmar Drive Extended to R-6,
Residential. (Note: Verbal agreement made by the
applicant's representative at the September 2, 1987,
meeting, and included in the Board's motion of
approval).
5.Agreement to construct stormwater detention facilities
in compliance with state and local code requirements.
Design storm recurrence interval shall be for the two
and ten year storm. Design shall be sufficient to
prevent overtopping of U.S. Rt. 29 for a design storm
with a 100 -year recurrence interval. The applicant
shall provide as much additional detention as is
feasible within the capacity available at the site in
the vicinity of the proposed basin shown on the
application plan.
